【摘要】：我國(guó)"走出去"企業(yè)在海外面臨被控侵犯知識(shí)產(chǎn)權(quán)、遭遇知識(shí)產(chǎn)權(quán)壁壘、自身知識(shí)產(chǎn)權(quán)受到侵害、在并購(gòu)過程中遭受知識(shí)產(chǎn)權(quán)損害、遭受知識(shí)產(chǎn)權(quán)合同陷阱等風(fēng)險(xiǎn)。原因在于企業(yè)事先準(zhǔn)備不夠、境外知識(shí)產(chǎn)權(quán)儲(chǔ)備不足、沒有認(rèn)真對(duì)待境外侵權(quán)指控、境外企業(yè)的刻意遏制及外部支持不力等。要有效防范海外知識(shí)產(chǎn)權(quán)風(fēng)險(xiǎn),企業(yè)需要構(gòu)建完善的風(fēng)險(xiǎn)防范體系,做好海外知識(shí)產(chǎn)權(quán)信息檢索分析及知識(shí)產(chǎn)權(quán)盡職調(diào)查,提高出口產(chǎn)品技術(shù)含量,科學(xué)布局海外知識(shí)產(chǎn)權(quán),積極組建海外知識(shí)產(chǎn)權(quán)聯(lián)盟,有效利用多種外部資源。
[Abstract]:China's "going out" enterprises are facing the charges of infringing intellectual property rights, encountered intellectual property barriers, their own intellectual property rights are infringed, in the process of mergers and acquisitions suffered intellectual property damage. The reason is that the enterprises are not prepared in advance, the foreign intellectual property reserves are insufficient, and they do not seriously treat the overseas infringement allegations. In order to effectively prevent the risk of overseas intellectual property, enterprises need to build a sound risk prevention system. We should do a good job in overseas intellectual property information retrieval and analysis and intellectual property due diligence, improve the technical content of export products, scientifically distribute overseas intellectual property rights, actively establish an overseas intellectual property alliance, and effectively utilize a variety of external resources.
