【摘要】："僵尸企業(yè)"的形成主要有三方面的原因,分別是受國家相關政策影響,企業(yè)在改制或升級中跟不上國家發(fā)展要求;受經(jīng)濟發(fā)展形勢變化影響,企業(yè)技術落后,陷入虧損;20世紀90年代國企改革不徹底導致的問題。為解決這些問題,借鑒美國、日本處置"僵尸企業(yè)"的經(jīng)驗,我國處置"僵尸企業(yè)"應從三方面著手:建立破產(chǎn)法庭,完善《企業(yè)破產(chǎn)法》;成立第三方機構——產(chǎn)業(yè)再生機構;建立完善的退出機制。
[Abstract]:There are three main reasons for the formation of "zombie enterprises", which are influenced by the relevant policies of the state, and the enterprises can not keep up with the requirements of national development in the process of restructuring or upgrading; Affected by the change of the economic development situation, the enterprises fall behind in technology and fall into losses; In 1990s, the problems caused by the reform of state-owned enterprises were not thorough. In order to solve these problems, we should learn from the experience of dealing with "zombie enterprises" in the United States and Japan. The disposal of "zombie enterprises" in China should be carried out from three aspects: establishing bankruptcy court and perfecting "Enterprise bankruptcy Law"; The establishment of a third party organization-Industrial Regeneration Organization; Establish a perfect exit mechanism.
