【摘要】：未保險(xiǎn)駕車者險(xiǎn)是美國(guó)保險(xiǎn)業(yè)應(yīng)對(duì)基于未保險(xiǎn)駕車者責(zé)任的交通事故損害的一種保險(xiǎn),是一種應(yīng)對(duì)第三人沒有保險(xiǎn)的保險(xiǎn),是美國(guó)保險(xiǎn)業(yè)的創(chuàng)造。該險(xiǎn)種對(duì)于被保險(xiǎn)人有效應(yīng)對(duì)在交通事故中受到未保險(xiǎn)駕車者損害的風(fēng)險(xiǎn)有積極意義。文章從未保險(xiǎn)駕車者險(xiǎn)存在的理論基礎(chǔ)出發(fā),對(duì)美國(guó)未保險(xiǎn)駕車者險(xiǎn)的險(xiǎn)種緣起、實(shí)踐、與其它救濟(jì)方式的對(duì)比、存在的問題等方面做了分析,并結(jié)合我國(guó)道路交通事故救助基金,對(duì)我國(guó)機(jī)動(dòng)車交通事故中不能從保險(xiǎn)渠道獲得賠償?shù)木葷?jì)部分的商業(yè)運(yùn)作模式做了思考。
[Abstract]:The uninsured driver's insurance is a kind of insurance against traffic accident damage based on the liability of the uninsured driver in the United States. It is a kind of insurance for the third person without insurance and is the creation of the American insurance industry. This kind of insurance has positive significance for the insured to deal with the risk of damage caused by uninsured drivers in traffic accidents. This paper analyses the origin, practice, comparison with other remedies, problems and so on of the uninsured drivers' insurance in the United States, based on the theoretical basis of the existence of the uninsured driver's insurance, and the analysis is made on the origin, practice, comparison with other relief methods and the existing problems of the uninsured driver's insurance in the United States. Combined with the road traffic accident relief fund in our country, the commercial operation mode of the relief part of the motor vehicle accident that can not be compensated from the insurance channel in our country is considered.
