【摘要】：轉(zhuǎn)移信托財產(chǎn)所有權(quán)或保有權(quán)是信托制度的本質(zhì)特征。人們對兩大法系財產(chǎn)觀念、衡平等現(xiàn)象存在認識上的錯誤。在財產(chǎn)觀念方面，他們主張建構(gòu)“雙重所有權(quán)”。為實現(xiàn)這樣學術(shù)抱負，有人又提出改造現(xiàn)行所有權(quán)或占有制度之主張。在衡平方面，，人們對大陸法系衡平現(xiàn)象要么視而不見，要么持懷疑和排斥態(tài)度。導致這些錯誤認識和主張產(chǎn)生的原因在于，人們在觀念上片面地強調(diào)權(quán)利，而輕視義務；過分崇尚權(quán)利、自由，而對權(quán)力持懷疑和不信任態(tài)度。信托財產(chǎn)所有權(quán)歸屬不僅關(guān)乎信托制度的構(gòu)建，而且關(guān)乎立法權(quán)與司法權(quán)如何配置、權(quán)利與義務誰為本位、法律與衡平的相互關(guān)系，等等。在我國，構(gòu)建信托制度不僅要求我們透過兩大法系財產(chǎn)觀念表象的差異看到它們作為制度之目的的一致性，而且，我們必須對法律中的衡平有所認知，并正確地對待它。唯有如此，才能在處理信托財產(chǎn)歸屬、構(gòu)建我國信托制度的過程中遠離歧途，走入正道。
[Abstract]:Transfer of ownership or tenure of trust property is the essential characteristic of trust system. There are some mistakes in understanding the property concept and equalization between the two legal systems. In terms of the concept of property, they advocate the construction of "double ownership". In order to realize such academic ambition, some people put forward the idea of reforming the current ownership or possession system. In the aspect of balance, people either ignore the phenomenon of civil law equality, or hold the attitude of scepticism and rejection. The reason for these misunderstandings and claims lies in the fact that people emphasize rights one-sidedly and despise obligations, and excessively advocate rights and freedoms, and hold a skeptical and distrustful attitude towards power. Ownership of trust property is not only related to the construction of trust system, but also to the allocation of legislative power and judicial power, who is the standard of rights and obligations, the relationship between law and balance, and so on. In our country, the construction of trust system not only requires us to see the consistency of the purpose of the two legal systems through the differences in the concept of property, but also, we must have a knowledge of the balance in the law and treat it correctly. Only in this way can we deal with the ownership of trust property and set up our trust system far from the wrong way.
