石家莊市中心城區(qū)經(jīng)營(yíng)性居住用地容積率管理研究

【摘要】:隨著控制性詳細(xì)規(guī)劃在我國(guó)的普及,容積率已成為規(guī)劃編制和管理工作的重要指標(biāo)。然而在我國(guó)土地有償使用和房地產(chǎn)市場(chǎng)快速發(fā)展的背景下,容積率指標(biāo)被更改的現(xiàn)象普遍存在,反映出容積率制定和管理方面存在的問(wèn)題。中華人民共和國(guó)住房和城鄉(xiāng)建設(shè)部于2012年2月頒布的《建設(shè)用地容積率管理辦法》也體現(xiàn)出國(guó)家政府對(duì)此問(wèn)題的重視程度。在快速城鎮(zhèn)化時(shí)期對(duì)容積率管理問(wèn)題進(jìn)行研究,不僅可提高開(kāi)發(fā)建設(shè)的科學(xué)性,還能促進(jìn)房地產(chǎn)市場(chǎng)的發(fā)展與城市環(huán)境相協(xié)調(diào)。 本文從容積率激勵(lì)制度和容積率管理規(guī)定兩個(gè)方面對(duì)國(guó)內(nèi)外的容積率管理制度進(jìn)行研究,較為全面的分析了美國(guó)容積率獎(jiǎng)勵(lì)制度和容積率轉(zhuǎn)移制度的理論和應(yīng)用狀況,并總結(jié)出該制度的主要特征。選取我國(guó)部分城市有關(guān)容積率激勵(lì)的規(guī)定進(jìn)行橫向比較,從獎(jiǎng)勵(lì)條件、獎(jiǎng)勵(lì)區(qū)域、獎(jiǎng)勵(lì)措施和獎(jiǎng)勵(lì)上限等方面總結(jié)出我國(guó)彈性管理的主要特點(diǎn)及其管理經(jīng)驗(yàn)借鑒。在容積率管理規(guī)定方面,選取了我國(guó)部分城市的地方性管理規(guī)定,對(duì)規(guī)定中的典型容積率管控要素進(jìn)行了橫向比較。 論文在對(duì)國(guó)內(nèi)外容積率管理制度研究的基礎(chǔ)上,以石家莊中心城區(qū)的經(jīng)營(yíng)性居住用地為研究對(duì)象,對(duì)2010—2012年出讓居住用地容積率與石家莊市2009版控制性詳細(xì)規(guī)劃和《石家莊市城鄉(xiāng)規(guī)劃局城市土地使用與建筑管理技術(shù)規(guī)定》的容積率控制指標(biāo)進(jìn)行比較,并從整體狀況、出讓年份、區(qū)位條件、行政分區(qū)等角度分析了出讓容積率對(duì)控規(guī)指標(biāo)和規(guī)定指標(biāo)的突破情況,結(jié)合具體案例的剖析,研究總結(jié)了經(jīng)營(yíng)性居住用地的容積率超標(biāo)現(xiàn)象。 最后在對(duì)居住用地容積率的綜合分析的基礎(chǔ)上,本文對(duì)石家莊市中心城區(qū)居住用地容積率管理中存在的問(wèn)題和原因進(jìn)行了分析闡述,進(jìn)一步從規(guī)劃編制彈性、容積率激勵(lì)制度、賦值綜合論證和健全監(jiān)督制度等方面提出了管理對(duì)策。
[Abstract]:With the popularization of controlled detailed planning in China, the volume ratio has become an important index of planning and management. However, under the background of paid land use and the rapid development of real estate market in China, the phenomenon that the index of volume rate is changed generally exists, which reflects the problems in the formulation and management of the volume rate. In February 2012, the Ministry of Housing and Urban-Rural Construction of the people's Republic of China promulgated the "measures for the Management of Building Land Volume ratio", which also reflected the importance attached by the national government to this problem. In the period of rapid urbanization, the research on the volume rate management can not only improve the scientific nature of the development and construction, but also promote the coordination between the development of the real estate market and the urban environment. This paper studies the volume rate management system at home and abroad from two aspects: the area rate incentive system and the floor area rate management regulation, and analyzes the theory and application of the American area rate incentive system and the volume rate transfer system in a more comprehensive way. And summarizes the main characteristics of the system. This paper selects some cities of our country to carry on the horizontal comparison from the reward condition, the reward area, the reward measure and the reward upper limit, summarizes the main characteristic and the management experience of the flexible management of our country from the reward condition, the reward area, the reward measure and the reward upper limit, and so on. In the aspect of area rate management regulations, the local management regulations of some cities in our country are selected, and the control elements of typical volume rate are compared horizontally. On the basis of the research on the management system of the volume rate at home and abroad, the paper takes the commercial residential land in Shijiazhuang central city as the research object. This paper compares the volume ratio of residential land in 2010-2012 with the control detailed planning of Shijiazhuang 2009 edition and the technical regulation of urban land use and building management of Shijiazhuang Urban and Rural Planning Bureau, and from the overall situation, This paper analyzes the breakthrough of the transfer area rate to the control and regulation index and the prescribed index from the point of view of the year of transfer, the location condition and the administrative division, and sums up the phenomenon of the excess of the volume rate of the commercial residential land in combination with the analysis of the concrete cases. Finally, based on the comprehensive analysis of residential land volume rate, this paper analyzes the existing problems and reasons in the management of residential land volume rate in Shijiazhuang central city, and further analyzes the flexibility of planning and the incentive system of volume rate. The paper puts forward the management countermeasures in the aspects of comprehensive argumentation of assignment and improvement of supervision system.
