【摘要】：投資型保險(xiǎn)作為新型保險(xiǎn)產(chǎn)品,兼具保障與投資的雙重屬性,在迅速發(fā)展的同時(shí)也因未在契約法的框架進(jìn)行系統(tǒng)分析,而在法律適用上不夠明確,故常引發(fā)糾紛。本文從契約法的角度進(jìn)行觀察,投資型保險(xiǎn)契約依其功能,可界分為保險(xiǎn)部分與投資部分。投資型保險(xiǎn)有著鮮明的特點(diǎn),且其投資部分具有信托屬性,進(jìn)而導(dǎo)致保險(xiǎn)人的說(shuō)明義務(wù)有所不同。就保險(xiǎn)部分與投資部分的關(guān)系,兩者在形式上統(tǒng)一并在實(shí)質(zhì)上具有依存關(guān)系,投資型保險(xiǎn)應(yīng)認(rèn)定為混合契約,但仍面臨著因投資部分的特性而帶來(lái)的法律適用難題,故應(yīng)向典型契約轉(zhuǎn)型。在投資型保險(xiǎn)應(yīng)定位為保險(xiǎn)抑或證券的爭(zhēng)議上,結(jié)合投資型保險(xiǎn)的特質(zhì)并考慮我國(guó)現(xiàn)實(shí)情況,應(yīng)界定為保險(xiǎn)契約的特殊形式,并對(duì)保險(xiǎn)契約法作相應(yīng)調(diào)整。
[Abstract]:As a new type of insurance product, investment-type insurance has the dual attributes of protection and investment. It has not been systematically analyzed in the framework of contract law while developing rapidly, but the application of the law is not clear enough. The investment insurance contract can be divided into insurance part and investment part according to its function. Investment insurance has distinct characteristics and its investment part has trust property. As to the relationship between the insurance part and the investment part, they are unified in form and dependent on each other in essence, so the investment-type insurance should be regarded as a mixed contract. However, it is still faced with the difficulty of applying the law due to the characteristics of the part of investment, so it should be transformed into a typical contract. In the dispute of whether the investment insurance should be defined as insurance or securities, considering the characteristics of investment insurance and considering the reality of our country, It should be defined as the special form of insurance contract, and the law of insurance contract should be adjusted accordingly.
