【摘要】:中國(guó)經(jīng)濟(jì)發(fā)展迅速,社會(huì)主義市場(chǎng)經(jīng)濟(jì)體制正在逐步完善,這就要求與之配套的金融制度的更新?lián)Q代。在資本與普惠金融的雙重呼喚下,小額信貸制度應(yīng)運(yùn)而生。本文將以法理學(xué)為依托,從風(fēng)險(xiǎn)管理的角度,剖析小額信貸制度存在的風(fēng)險(xiǎn),解讀現(xiàn)有小額信貸法律監(jiān)管模式,并在人權(quán)、效率以及普惠金融理念下探求一套更加行之有效的小額信貸風(fēng)險(xiǎn)防范機(jī)制。為防范風(fēng)險(xiǎn),在開(kāi)發(fā)小額信貸催收系統(tǒng)的基礎(chǔ)上,行政規(guī)制必須有管有放,放開(kāi)利率,優(yōu)惠稅收。配合著分級(jí)監(jiān)管,小額信貸產(chǎn)品的消費(fèi)者要樹立維權(quán)理念,而我們的社會(huì)環(huán)境也必須從外部發(fā)力,配套的數(shù)據(jù)支撐,合理的輿論引導(dǎo)都大可降低風(fēng)險(xiǎn)。糾紛的發(fā)生是必然,行之有效的司法解紛渠道就顯得尤為重要。獨(dú)立的金融消費(fèi)者保護(hù)委員會(huì)作前提,專業(yè)的金融仲裁委為橋梁,民事法院規(guī)劃專門的解紛流程,刑法最后兜底,那么糾紛的妥善解決也就隨之成為必然?偠灾,我們從不避諱小額信貸這一新生金融活動(dòng)存在風(fēng)險(xiǎn)的客觀事實(shí),但我們更應(yīng)該看到風(fēng)險(xiǎn)背后巨大的制度功能及社會(huì)效益,因噎廢食不可取,裹足逡巡不可效,在充分認(rèn)識(shí)風(fēng)險(xiǎn)并遵循合理防范機(jī)制的前提下,小額信貸定能發(fā)揮巨大的經(jīng)濟(jì)及社會(huì)功能,不但完成扶貧減困、活躍融資的目標(biāo),更為構(gòu)建完善的金融體系添磚加瓦。
[Abstract]:With the rapid economic development of China and the gradual improvement of the socialist market economic system, this requires the upgrading of the corresponding financial system. Under the dual demand of capital and inclusive finance, The microfinance system emerges as the times require. Based on jurisprudence, this paper will analyze the risks existing in the microfinance system from the perspective of risk management, and interpret the existing legal supervision model of microfinance, and in human rights, Under the concept of efficiency and inclusive finance, we should explore a more effective mechanism for preventing microcredit risks. In order to prevent risks, on the basis of developing a microfinance collection system, administrative regulations must be managed and released, and interest rates should be liberalized. Preferential taxation. In line with hierarchical supervision, consumers of microcredit products should establish the concept of safeguarding their rights, and our social environment must also contribute from the outside, supporting the supporting data. Reasonable public opinion guidance can greatly reduce the risk. The occurrence of disputes is inevitable, and the effective judicial channels for resolving disputes are particularly important. The Independent Financial Consumer Protection Commission is the premise and the professional Financial Arbitration Commission is the bridge. If the civil court plans a special process of resolving disputes, and the criminal law finally reaches the bottom, the proper resolution of disputes becomes inevitable. In a word, we never avoid the objective fact that microfinance, a nascent financial activity, is at risk. However, we should also see the huge institutional functions and social benefits behind the risks. It is not advisable to stop eating because of choking, and it is not effective to do so. On the premise of fully recognizing the risks and following the reasonable prevention mechanism, Microfinance can play a huge economic and social function, not only to achieve poverty alleviation, active financing goals, but also to build a sound financial system.
