【摘要】：為解決電子支票真實性問題,除技術(shù)標(biāo)準(zhǔn)須具體和統(tǒng)一外,還需為使用替代支票或缺乏接觸紙質(zhì)支票機(jī)會的當(dāng)事人建立一種損失賠付機(jī)制,以及為寄送、提示和返還替代支票的銀行設(shè)置避免重復(fù)提示付款的擔(dān)保義務(wù)。對電子匯票權(quán)利正當(dāng)性的考察,除拓展紙質(zhì)商業(yè)票據(jù)登記查詢功能及改進(jìn)和推廣相關(guān)安全技術(shù)外,可引入"控制權(quán)"規(guī)則以衡量電子匯票的可靠性;同時,可建立全國統(tǒng)一的電子債權(quán)登記系統(tǒng)以增強(qiáng)票據(jù)權(quán)利歸屬證明的確定性;票據(jù)市場交易系統(tǒng)和規(guī)則體系應(yīng)具有一致性、集中性和平等性以促進(jìn)電子票據(jù)對付中票據(jù)權(quán)利的實現(xiàn)。在認(rèn)定電子票據(jù)簽名的效力和保障電子票據(jù)簽名的可靠性上,應(yīng)厘清影響電子票據(jù)簽名可靠性的檢測因素,通過橋認(rèn)證機(jī)構(gòu)模式推進(jìn)電子身份管理和認(rèn)證服務(wù)的兼容性,借助電子公證和電子數(shù)據(jù)司法鑒定機(jī)制解決認(rèn)證機(jī)構(gòu)的中立性問題,確定電子票據(jù)簽名的司法效力。
[Abstract]:In order to address the authenticity of electronic cheques, in addition to technical standards that need to be specific and uniform, there is also a need to establish a loss indemnity mechanism for parties using alternative cheques or lack of access to paper cheques, as well as to send them, The obligation of security to avoid duplicate presentation for payment is set up by presenting and returning substituted cheques. The investigation of the legitimacy of the rights of electronic bills of exchange, in addition to expanding the function of registering and querying paper commercial bills and improving and popularizing the relevant security techniques, The "right of control" rule may be introduced to measure the reliability of electronic bills of exchange; at the same time, a unified national electronic creditor's rights registration system can be established to enhance the certainty of the ownership of instruments, and there should be consistency between the trading system and the rules system in the bill market. Centralization and equality are used to promote the realization of the rights of electronic instruments in dealing with electronic instruments. In determining the validity of electronic instruments' signatures and ensuring the reliability of electronic instruments' signatures, it is necessary to clarify the testing factors that affect the reliability of electronic instruments' signatures. Through the bridge certification organization model to promote the compatibility of electronic identity management and authentication service, to solve the neutral problem of certification organization by means of electronic notarization and electronic data forensic authentication mechanism, and to determine the judicial effect of electronic bill signature.
