【摘要】：伴隨著我國社會主義市場經(jīng)濟的迅猛步伐,我國的城市化也進入了飛速發(fā)展的階段,據(jù)相關(guān)數(shù)據(jù)顯示,我國目前的城市化水平已經(jīng)超過了50%。在我國城市化迅猛發(fā)展的過程中,城市拆遷的推進作用巨大。而在城市拆遷中,城市商業(yè)性拆遷的比例已達(dá)到70%-80%,因此,可以說,城市商業(yè)性拆遷是我國城市化過程中的助推器。城市商業(yè)性拆遷作為一種民事行為,地方政府不宜過多干預(yù),而應(yīng)該在市場的主導(dǎo)下宏觀地做好監(jiān)管工作,維護拆遷雙方特別是被拆遷人的合法利益,保障城市商業(yè)性拆遷的穩(wěn)定秩序,進而保障社會的安定與和諧。但是,在近些年的城市商業(yè)性拆遷中,由于地方政府的種種失范行為,釀成了一樁樁城市商業(yè)性拆遷流血悲劇,這對民眾的人身安全和社會的安定和諧構(gòu)成了嚴(yán)重的威脅,引起了社會各界的高度關(guān)注。因此,當(dāng)務(wù)之急就是進一步研究我國城市商業(yè)性拆遷中地方政府行為的失范與規(guī)范問題。 本文首先對城市商業(yè)性拆遷中地方政府行為失范的相關(guān)概念和理論進行闡述,接著闡述地方政府在城市商業(yè)性拆遷中失范行為的具體表現(xiàn)和原因,之后結(jié)合近些年城市商業(yè)性拆遷實踐中地方政府行為失范的典型案例進行簡要分析與總結(jié),旨在在理論和實踐相結(jié)合的基礎(chǔ)上在文章最后提出有效規(guī)范我國城市商業(yè)性拆遷中地方政府行為的對策建議。 本文的第一部分是緒論,簡要闡述了本文撰寫的背景和意義、國內(nèi)外相關(guān)的研究現(xiàn)狀、本文撰寫的研究思路與研究方法以及本文的創(chuàng)新點與不足之處。本文的第二部分是理論分析,通過闡述和分析城市商業(yè)性拆遷的內(nèi)涵、地方政府行為的內(nèi)涵、所涉及的相關(guān)理論以及規(guī)范城市商業(yè)性拆遷中地方政府行為的意義來奠定本文的理論基礎(chǔ)。其中,城市商業(yè)性拆遷的內(nèi)涵包括城市商業(yè)性拆遷的概念、應(yīng)遵循的原則和應(yīng)遵循的法律程序。地方政府的內(nèi)涵包括地方政府行為的概念、特征和類型。所涉及的相關(guān)理論包括政府管制理論、新經(jīng)濟人理論、尋租理論和博弈理論。本文的第三部分詳細(xì)分析了我國城市商業(yè)性拆遷中地方政府行為失范的一些具體表現(xiàn)和導(dǎo)致地方政府行為失范的因素。其中,城市商業(yè)性拆遷中的地方政府行為失范的具體表現(xiàn)有：引進違背城市規(guī)劃的商業(yè)性拆遷項目、審批發(fā)放拆遷許可證不嚴(yán)格、與地產(chǎn)開發(fā)商結(jié)盟、監(jiān)管城市商業(yè)性拆遷不到位。導(dǎo)致地方政府在城市商業(yè)性拆遷中行為失范的因素有：地方政府自身利益的驅(qū)動、地方政府官員考核和晉升制度不合理、地方政府角色定位不正確、現(xiàn)行法律法規(guī)不健全、行政監(jiān)督作用不明顯。本文的第四部分是關(guān)于近些年我國城市商業(yè)性拆遷中地方政府行為失范的一個典型案例分析。筆者通過引進湖南省婁底市新化縣拆遷事件,并對此次拆遷中地方政府行為失范的表現(xiàn)和原因進行分析和總結(jié),從而有效力證本文第三部分的內(nèi)容。本文的第五部分是對策建議部分,筆者在這部分總結(jié)出了規(guī)范我國城市商業(yè)性拆遷中地方政府行為的五大對策建議。這五大對策建議分別是：調(diào)整地方政府官員的利益觀念、完善地方政府官員的考核和晉升制度、糾正地方政府在城市商業(yè)性拆遷中的角色定位、完善相關(guān)法律規(guī)范與機制、強化行政監(jiān)督的作用。
[Abstract]:With the rapid pace of China's socialist market economy, the city of our country has entered a stage of rapid development, according to the relevant data show that the current city in China has exceeded the level of the 50%. in China's rapid development of the city, promote the city demolition for the demolition in the city in great. City commercial demolition, the proportion has reached 70%-80%, therefore, it can be said that the city commercial demolition is a booster of city of our country in the process of city commercial demolition. As a kind of civil action, the local government should not interfere too much, but should be macro supervision dominant in the market, especially the maintenance of buildings on both sides is the legitimate interests of the residents, to ensure the stable order of city commercial demolition, and safeguard social stability and harmony. However, in the city commercial buildings in recent years, due to various loss of local government Fan behavior, causing a pile of city commercial demolition of the bloody tragedy, people's personal safety and social stability and harmony constitutes a serious threat, aroused the concern of the society. Therefore, anomie and norms is to further study the behavior of local government a pressing matter of the moment of our city commercial demolition.
This paper first elaborates on the behavior of local government in the Lost City Commercial demolition related concepts and then fan theory, discussed the specific performance and the reason of local government anomie behavior in city commercial demolition, and briefly summarize and analysis of typical cases in recent years after the combination of city commercial demolition in the practice of local government Behavior Anomie, to based on the combination of theory and practice in the article finally put forward some suggestions to effectively regulate the behavior of local government of China's city commercial demolition.
The first part is the introduction, briefly introduces the background and significance of this writing, the domestic and foreign related research, this thesis research ideas and research methods, innovation and shortcomings of this paper. The second part is the theoretical analysis, through analysis and explain the connotation of city commercial demolition, the connotation of local government the behavior, related theories and standardize the behavior of local government city commercial demolition significance to lay the theoretical foundation of this paper. The connotation of city commercial buildings including the concept of city commercial demolition, should follow the principles and should follow the legal procedure. The connotation of the concept of local government including the behavior of local government the characteristics, and types. The related theories include government regulation theory, new economic theory, rent-seeking theory and game theory. The third part is analyzed in detail. The behavior of local government in China City Commercial demolition of the anomie of some specific performance and result in Local Government Behavior Anomie factors. Among them, the local government behavior in city commercial demolition of the loss in specific performance standard is: the introduction of city planning against commercial demolition project, the wholesale placed demolition permit is not strict, alliance with the real estate developers, supervision of city commercial demolition is not in place. The factors leading to the behavior of local government in city commercial demolition of anomie: driven by the interests of local government, local government official assessment and promotion system is unreasonable, positioning the role of local government is not correct, the existing laws and regulations are not perfect, the administrative supervision function is not obvious. The fourth part is about the analysis of a typical case of local government behavior of commercial buildings in China in recent years in the city of anomie. Through the introduction of Loudi city in Hunan Province Xinhua County demolition event, and the behavior of local government in the demolition of performance and the reason of the losing fan were analyzed and summarized, so as to effectively prove the third part of this article. The fifth part is the suggestion part, in this part the author summarizes five countermeasures to regulate the behavior of local government in China City Commercial demolition in this. Five suggestions are: adjusting the interests of local government officials concept, improve the evaluation of local government officials and promotion system, the role of local government in the correct city commercial demolition, perfecting the relevant legal norms and mechanisms, strengthen the administrative supervision.
