【摘要】：隨著我國現(xiàn)代化建設(shè)的推進(jìn),城鄉(xiāng)一體化呈現(xiàn)快速發(fā)展的態(tài)勢,農(nóng)村土地流轉(zhuǎn)規(guī)模不斷擴(kuò)大。在農(nóng)村,土地承載著保障農(nóng)民生活和發(fā)展農(nóng)業(yè)生產(chǎn)的重任,土地收益是農(nóng)民收入的重要來源,如何在農(nóng)村土地流轉(zhuǎn)過程中保護(hù)好農(nóng)民權(quán)益,不僅關(guān)系到農(nóng)業(yè)、農(nóng)民、農(nóng)村發(fā)展的全局,而且關(guān)系到和諧社會(huì)建設(shè)和全面建成小康社會(huì)偉大目標(biāo)的實(shí)現(xiàn)。本文以馬克思主義基本理論為指導(dǎo),以改革開放以來的中國農(nóng)村土地改革實(shí)踐為背景,從農(nóng)村土地流轉(zhuǎn)和農(nóng)民權(quán)益保障的關(guān)系出發(fā),首先對(duì)土地流轉(zhuǎn)、農(nóng)民權(quán)益等概念進(jìn)行了科學(xué)界定,對(duì)土地流轉(zhuǎn)中產(chǎn)生的相關(guān)權(quán)益和土地流轉(zhuǎn)的必然性進(jìn)行了闡釋和說明;然后,對(duì)農(nóng)村土地流轉(zhuǎn)中農(nóng)民權(quán)益受損現(xiàn)狀從農(nóng)民土地流轉(zhuǎn)收益受到損害、與土地相關(guān)的權(quán)利受到損害、失去基本生活保障以及就業(yè)權(quán)益受到損害四個(gè)方面進(jìn)行了分析;在此基礎(chǔ)上,以科學(xué)發(fā)展觀為指導(dǎo),堅(jiān)持以人為本,緊緊圍繞如何保障農(nóng)民權(quán)益,有針對(duì)性地從完善土地流轉(zhuǎn)制度、培育農(nóng)村土地流轉(zhuǎn)中介機(jī)構(gòu)、明確政府職能以及提高農(nóng)民就業(yè)能力四個(gè)方面提出保障農(nóng)民權(quán)益的措施,構(gòu)建起了在農(nóng)村土地流轉(zhuǎn)中維護(hù)和保障好農(nóng)民權(quán)益的對(duì)策體系,從而推動(dòng)現(xiàn)代農(nóng)業(yè)的發(fā)展和全面建成小康社會(huì)進(jìn)程。
[Abstract]:With the promotion of modernization in China, the integration of urban and rural areas presents a rapid development trend, and the scale of rural land circulation continues to expand. In rural areas, land carries the important task of ensuring farmers' life and developing agricultural production. Land income is an important source of farmers' income. How to protect farmers' rights and interests in the process of rural land circulation is not only related to the overall situation of agriculture, farmers, rural development, but also related to the construction of a harmonious society and the realization of the great goal of building a well-off society in an all-round way. Under the guidance of Marxist basic theory, taking the practice of rural land reform in China since the reform and opening up as the background, starting from the relationship between rural land circulation and farmers' rights and interests protection, this paper first defines the concepts of land circulation and farmers' rights and interests, and explains the related rights and interests in land circulation and the necessity of land circulation. Then, this paper analyzes the present situation of the damage of farmers' rights and interests in rural land circulation from four aspects: the damage of farmers' income of land circulation, the damage of land-related rights, the loss of basic living security and the damage of employment rights and interests. On this basis, under the guidance of the scientific concept of development, adhere to people-oriented, closely around how to protect the rights and interests of farmers, targeted from four aspects of perfecting the land circulation system, cultivating rural land circulation intermediary institutions, defining government functions and improving farmers' employment ability, this paper puts forward measures to protect farmers' rights and interests in rural land circulation, and constructs a countermeasures system to safeguard and protect farmers' rights and interests in rural land circulation. In order to promote the development of modern agriculture and the process of building a well-off society in an all-round way.
