【摘要】：深圳近年在二次開發(fā)機制創(chuàng)新中使用了面向土地權(quán)益主體的發(fā)展控制政策,疏解了土地集中儲備環(huán)節(jié)出現(xiàn)的障礙,但是與既有土地使用權(quán)和規(guī)劃制度產(chǎn)生矛盾,也影響土地利用管理規(guī)則的穩(wěn)定性。如何解決其中的矛盾對于創(chuàng)新成果的制度性轉(zhuǎn)變非常關(guān)鍵。在國有土地使用權(quán)制度下,隨著土地權(quán)益從集中向個體轉(zhuǎn)移,土地利用管理將面臨新的要求。以此為背景,探討了規(guī)劃對土地利用改變?nèi)^程進行規(guī)劃控制的意義和理論上的可能性,以及相應(yīng)規(guī)劃權(quán)力與機制的調(diào)整。
[Abstract]:In recent years, Shenzhen has used the development control policy oriented to the main body of land rights and interests in the innovation of the secondary development mechanism, which has solved the obstacles in the link of centralized land reserve, but has contradictions with the existing land use right and planning system. It also affects the stability of land use management rules. How to solve the contradiction is very key to the institutional transformation of innovation results. Under the system of state-owned land use right, with the transfer of land rights and interests from centralization to individual, land use management will face new requirements. Based on this background, this paper probes into the significance and theoretical possibility of planning control over the whole process of land use change, as well as the adjustment of the corresponding planning power and mechanism.
