【摘要】："長(zhǎng)久不變"是"三權(quán)分置"有效實(shí)現(xiàn)的前提和基礎(chǔ),而"三權(quán)分置"的有效實(shí)現(xiàn)有助于鞏固"長(zhǎng)久不變"的制度基礎(chǔ)。"三權(quán)分置"與"長(zhǎng)久不變"政策協(xié)同困境主要表現(xiàn)在政策目標(biāo)、政策制定、政策范圍、政策執(zhí)行四個(gè)層面。促進(jìn)"三權(quán)分置"與"長(zhǎng)久不變"政策協(xié)同,應(yīng)從如下方面著手:一是成立"集體經(jīng)濟(jì)組織"機(jī)構(gòu),賦予土地"所有權(quán)"完整權(quán)能,落實(shí)土地"所有權(quán)";二是確定"集體經(jīng)濟(jì)組織"成員,界定土地"承包權(quán)"權(quán)利內(nèi)涵,穩(wěn)定土地"承包權(quán)";三是探索多種途徑農(nóng)業(yè)經(jīng)營(yíng)模式,界定土地"經(jīng)營(yíng)權(quán)"物權(quán)性質(zhì),放活土地"經(jīng)營(yíng)權(quán)"。
[Abstract]:"permanent invariance" is the premise and foundation of the effective realization of "three power division", and the effective realization of "three power separation" is helpful to consolidate the system foundation of "long term invariance". " The dilemma of policy coordination between "three power division" and "long-term invariance" is mainly manifested in four levels: policy objective, policy formulation, policy scope and policy implementation. To promote the policy synergy between "three rights division" and "long-term invariance", we should start from the following aspects: first, set up "collective economic organization" organization, endow land "ownership" with complete power, and implement land "ownership"; Second, determine the members of "collective economic organization", define the connotation of land "contract right" and stabilize land "contract right"; Third, explore various ways of agricultural management mode, define the real right nature of land "management right", release land "management right".
