【摘要】：伴隨城鎮(zhèn)化進(jìn)程,人口流動(dòng)頻繁,農(nóng)村人口越來越多的涌入城市,并選擇將曾經(jīng)賴以生存的農(nóng)用土地進(jìn)行協(xié)議流轉(zhuǎn),以謀求土地使用權(quán)讓渡的收益。在流轉(zhuǎn)中,保護(hù)農(nóng)用地原用途是基本前提,但在流轉(zhuǎn)過程中卻出現(xiàn)了大量的非法轉(zhuǎn)用現(xiàn)象,而現(xiàn)有的法律規(guī)制卻無法及時(shí)遏制。本文嘗試從協(xié)議流轉(zhuǎn)手段獲取農(nóng)用地進(jìn)行非法轉(zhuǎn)用入手,通過梳理整體立法和具體規(guī)制措施上存在的部分問題,如對(duì)轉(zhuǎn)用的流轉(zhuǎn)合同效力、轉(zhuǎn)用的行政監(jiān)管、非法占用農(nóng)用地罪的客觀行為變動(dòng)等進(jìn)行分析論證,并提出一些解決建議,以給日后立法提供一些細(xì)節(jié)上的參考意見,也可以在具體解決相關(guān)實(shí)際法律問題時(shí)提供一些思路。
[Abstract]:With the urbanization process, the population flow frequently, more and more rural people pour into the city, and choose to transfer the agricultural land which once depended on for survival by agreement, in order to seek the income of land use right transfer. In the circulation, the protection of the original use of agricultural land is the basic premise, but in the process of circulation there has been a large number of illegal diversion phenomenon, but the existing legal regulations can not be stopped in time. This paper attempts to obtain agricultural land from the agreement transfer means to carry on the illegal diversion, through combing the whole legislation and the concrete regulation measure on the existence of some problems, such as the transfer of the effectiveness of the transfer contract, diversion of administrative supervision, This paper analyzes and demonstrates the change of objective behavior of the crime of illegal occupation of agricultural land, and puts forward some suggestions to solve the problem, so as to provide some detailed suggestions for legislation in the future, and can also provide some ideas for solving the relevant practical legal problems.
