【摘要】：在城鎮(zhèn)化、工業(yè)化背景下,農(nóng)村經(jīng)濟(jì)社會(huì)發(fā)展呈現(xiàn)出的新變化對(duì)農(nóng)村土地制度改革提出了新的要求。十八屆三中全會(huì)精神鼓勵(lì)農(nóng)村土地承包經(jīng)營(yíng)權(quán)在公開(kāi)市場(chǎng)上向?qū)I(yè)大戶、家庭農(nóng)場(chǎng)、農(nóng)民合作社、農(nóng)業(yè)企業(yè)流轉(zhuǎn),支持農(nóng)業(yè)經(jīng)營(yíng)方式創(chuàng)新,建立兼顧國(guó)家、集體、個(gè)人的土地收益分配機(jī)制。2016年中央一號(hào)文件指出要用發(fā)展新理念破解“三農(nóng)”新難題,厚植農(nóng)業(yè)農(nóng)村發(fā)展優(yōu)勢(shì),加大創(chuàng)新驅(qū)動(dòng)力度,推進(jìn)農(nóng)業(yè)供給側(cè)結(jié)構(gòu)性改革,加快轉(zhuǎn)變農(nóng)業(yè)發(fā)展方式,保持農(nóng)業(yè)穩(wěn)定發(fā)展和農(nóng)民持續(xù)增收,走產(chǎn)出高效、產(chǎn)品安全、資源節(jié)約、環(huán)境友好的農(nóng)業(yè)現(xiàn)代化道路,推動(dòng)新型城鎮(zhèn)化與新農(nóng)村建設(shè)雙輪驅(qū)動(dòng)、互促共進(jìn),讓廣大農(nóng)民平等參與現(xiàn)代化進(jìn)程、共同分享現(xiàn)代化成果。農(nóng)村供給側(cè)改革是對(duì)農(nóng)村改革發(fā)展的進(jìn)一步探索,農(nóng)村土地經(jīng)營(yíng)權(quán)流轉(zhuǎn)是供給側(cè)改革的一個(gè)重要方面,更是轉(zhuǎn)變農(nóng)業(yè)發(fā)展方式、推動(dòng)農(nóng)業(yè)現(xiàn)代化的關(guān)鍵。實(shí)踐證明農(nóng)村土地經(jīng)營(yíng)權(quán)流轉(zhuǎn)能夠有效提高土地資源的綜合開(kāi)發(fā)效率和農(nóng)業(yè)產(chǎn)出水平,符合農(nóng)村社會(huì)生產(chǎn)力發(fā)展的要求。但是,在農(nóng)村土地經(jīng)營(yíng)權(quán)流轉(zhuǎn)中,由于利益分配不合理及相關(guān)利益調(diào)節(jié)機(jī)制缺失導(dǎo)致利益矛盾糾紛的發(fā)生,挫傷了各利益主體的積極性、阻礙了農(nóng)地經(jīng)營(yíng)權(quán)順利流轉(zhuǎn)、制約了農(nóng)業(yè)現(xiàn)代化進(jìn)程。如何通過(guò)建立兼顧國(guó)家、集體、個(gè)人的收益分配機(jī)制,實(shí)現(xiàn)公平合理的分配農(nóng)地經(jīng)營(yíng)權(quán)流轉(zhuǎn)利益,有效調(diào)節(jié)各種利益矛盾,實(shí)現(xiàn)利益相關(guān)者的利益平衡,是我們所面臨的一個(gè)重要課題。本文以農(nóng)地經(jīng)營(yíng)權(quán)流轉(zhuǎn)為基礎(chǔ)、以利益分配和調(diào)節(jié)為切入點(diǎn),在地租理論和地價(jià)理論、資源價(jià)值理論的支撐下,分析了農(nóng)地經(jīng)營(yíng)權(quán)流轉(zhuǎn)中的利益來(lái)源、相關(guān)利益主體構(gòu)成及利益目標(biāo)、各利益主體在自利條件下的理性選擇、各利益主體間利益沖突的表現(xiàn)及原因、制約各利益主體利益實(shí)現(xiàn)的影響因素等,根據(jù)實(shí)踐經(jīng)驗(yàn)和教訓(xùn)總結(jié)出了實(shí)現(xiàn)各利益主體合理利益的保障措施,為農(nóng)地經(jīng)營(yíng)權(quán)流轉(zhuǎn)中各種利益沖突的調(diào)解提供參考。論文一共五部分,第一部分為導(dǎo)論,主要介紹了論文選題背景、研究意義、國(guó)內(nèi)外研究現(xiàn)狀、主要內(nèi)容和方法以及創(chuàng)新之處與不足;第一章為相關(guān)理論概述,闡述了土地經(jīng)營(yíng)權(quán)流轉(zhuǎn)的內(nèi)涵和動(dòng)因,從地租和地價(jià)的角度分析了利益之源、利益沖突的表現(xiàn)及原因、影響因素等;第二章對(duì)農(nóng)地經(jīng)營(yíng)權(quán)流轉(zhuǎn)中的利益相關(guān)者進(jìn)行了分析,分析了相關(guān)利益主體的構(gòu)成及利益目標(biāo)、各利益主體的理性選擇、利益分配中存在的主要問(wèn)題、利益調(diào)節(jié)的實(shí)踐探索,是文章的核心與主體;第三章根據(jù)農(nóng)地經(jīng)營(yíng)權(quán)流轉(zhuǎn)的利益調(diào)節(jié)經(jīng)驗(yàn)提出了公平合理分配流轉(zhuǎn)利益的對(duì)策措施;第五部分為結(jié)論和展望。
[Abstract]:Under the background of urbanization and industrialization, the new changes in rural economic and social development put forward new requirements for the reform of rural land system. The spirit of the third Plenary session of the 18th CPC Central Committee encouraged the transfer of the right of contracted management of rural land to professional large households, family farms, farmers' cooperatives, and agricultural enterprises in the open market, to support innovation in agricultural management methods, and to establish a collective system that takes into account both the state and the collective. Individual land income distribution mechanism. In 2016, the first document of the Central Committee pointed out that we should use the new concept of development to solve the new problems of "agriculture, rural areas and farmers," strengthen the advantages of rural development in planting agriculture, increase the strength of innovation drive, and promote the structural reform on the supply side of agriculture. Speed up the transformation of the agricultural development mode, maintain the stable development of agriculture and the sustained increase of farmers' income, take the road of agricultural modernization with high output efficiency, product safety, resource saving, and environmental friendliness, and promote the new type of urbanization and the construction of a new countryside. Promote mutual progress, let the broad masses of farmers participate in the modernization process on an equal footing, and share the fruits of modernization. Rural supply-side reform is a further exploration of rural reform and development. The circulation of rural land management right is an important aspect of supply-side reform, and it is also the key to change the mode of agricultural development and promote agricultural modernization. Practice has proved that the circulation of rural land management rights can effectively improve the comprehensive development efficiency of land resources and the level of agricultural output, and meet the requirements of the development of rural social productive forces. However, in the circulation of rural land management right, because of the unreasonable distribution of interests and the lack of relevant interest adjustment mechanism, the conflicts of interests occur, which dampens the enthusiasm of the main interests and hinders the smooth circulation of the management rights of agricultural land. Restricted agricultural modernization progress. How to achieve a fair and reasonable distribution of farmland management rights by establishing a mechanism of income distribution that takes into account the state, the collective and the individual, effectively adjusts all kinds of interest contradictions, and realizes the interest balance of the stakeholders. It is an important subject we are facing. Based on the transfer of farmland management right, with interest distribution and regulation as the starting point, this paper analyzes the source of interest in the transfer of farmland management right under the support of land rent theory, land price theory and resource value theory. The composition and goal of the relevant interest subjects, the rational choice of each interest subject under the self-interest condition, the expression and reason of the interest conflict among the various interest subjects, the influence factors that restrict the realization of the interest main body, etc. According to the practical experience and lessons, this paper summarizes the safeguard measures to realize the reasonable interests of various stakeholders, and provides a reference for the mediation of various conflicts of interest in the circulation of farmland management rights. There are five parts of the paper, the first part is the introduction, mainly introduces the background of the thesis, research significance, research status at home and abroad, the main contents and methods as well as innovations and shortcomings; the first chapter is a summary of relevant theories. This paper expounds the connotation and motivation of land management right transfer, analyzes the source of interest, the expression and cause of interest conflict, the influencing factors and so on from the angle of land rent and land price. It is the core and main body of the article to analyze the composition and goal of the relevant interest subject, the rational choice of each interest subject, the main problems existing in the interest distribution, and the practical exploration of the interest regulation. The third chapter puts forward the countermeasures of fair and reasonable distribution of the benefits of the transfer of agricultural land management rights according to the experience of interest regulation; the fifth part is the conclusion and prospect.
