【摘要】：當(dāng)前,我國在工業(yè)化的推動下,經(jīng)濟處于快速發(fā)展時期,城鄉(xiāng)間的差距也越來越大,為此,我國提出了城鄉(xiāng)一體化發(fā)展的模式。由于人口的不斷擴增,農(nóng)林耕地與建設(shè)用地之間的矛盾也逐步加重,土地資源已然成為經(jīng)濟發(fā)展的“瓶頸”,城鎮(zhèn)化的推進必然會面臨諸多挑戰(zhàn)。農(nóng)村宅基地作為農(nóng)村土地的主要部分,并且與農(nóng)民的利益息息相關(guān)。宅基地對于農(nóng)民而言,不僅是農(nóng)民居住、娛樂的主要場所,又承載著農(nóng)民的生產(chǎn)、生活、經(jīng)濟、文化等多種功能。由于我國對于宅基地流轉(zhuǎn)的限制,造成了大量宅基地的閑置。農(nóng)民為獲取利益,在利益的驅(qū)使及市場需求的推動下,促進了宅基地隱形流轉(zhuǎn)市場的形成,私下對宅基地進行交易,不僅交易雙方的利益得不到保障,同時也損害了村集體經(jīng)濟組織的利益。宅基地是特殊的土地資源,宅基地的自由流轉(zhuǎn)不僅能緩解城鎮(zhèn)化發(fā)展過程中對于土地的需求緊張,還能提高土地的利用率,提高土地的價值。本文首先提出了研究背景,總結(jié)了國內(nèi)外對于宅基地管理及流轉(zhuǎn)的研究動態(tài),并且介紹了與宅基地管理相關(guān)的理論。其次以山西省臨汾市為研究對象,對當(dāng)?shù)卣氐幕厩闆r及利用現(xiàn)狀進行了概述和實證分析。通過分析得出了宅基地管理過程中存在的問題:第一是在分配環(huán)節(jié)缺乏相關(guān)法律,從而造成了超標(biāo)宅基地隨處可見的現(xiàn)象;第二是在宅基地的使用環(huán)節(jié)存在產(chǎn)權(quán)不明晰,使得農(nóng)民對于宅基地使用權(quán)的理解較為模糊,且土地利用率低的現(xiàn)象;第三是在流轉(zhuǎn)環(huán)節(jié)中存在的問題是由于當(dāng)前我國法律不允許宅基地流轉(zhuǎn),但是市場對于宅基地的需求量巨大,從而促進了隱形流轉(zhuǎn)市場的形成,但是隱形流轉(zhuǎn)市場得不到法律的保護,這就造成了越來越多的宅基地利益糾紛事件;第四是在監(jiān)管方面不到位;并且總結(jié)得出宅基地分配、使用、流轉(zhuǎn)、監(jiān)管過程中存在諸多問題的主要原因在于我國限制農(nóng)村宅基地的自由流轉(zhuǎn),并總結(jié)了由于限制農(nóng)村宅基地流轉(zhuǎn)而造成的問題,主要表現(xiàn)在以下幾個方面:第一是加劇了城鄉(xiāng)二元分割;第二是農(nóng)村的財產(chǎn)權(quán)受到侵害;第三是土地得不到有效利用;第四是隱形的宅基地交易日漸猖獗,從而造成大量產(chǎn)權(quán)糾紛。最后,通過研究分析的基礎(chǔ)上進行總結(jié),提出了對于臨汾市農(nóng)村宅基地管理制度的設(shè)計思路:第一是要制定相關(guān)法律、法規(guī)規(guī)范農(nóng)村宅基地的分配;第二是要通過完善農(nóng)村宅基地登記、確權(quán)制度,使宅基地產(chǎn)權(quán)明晰以保證農(nóng)村宅基地的合理使用;第三是配套相關(guān)制度,保障宅基地的順利流轉(zhuǎn);第四是加強監(jiān)管;第五是要啟動政策先行試點。
[Abstract]:At present, under the promotion of industrialization, our economy is in a period of rapid development, and the gap between urban and rural areas is growing. Therefore, China has put forward a model of urban-rural integration development. Due to the continuous expansion of population, the contradiction between agricultural and forestry farmland and construction land is gradually aggravated, land resources have become the "bottleneck" of economic development, and the promotion of urbanization will inevitably face many challenges. As the main part of rural land, rural homestead is closely related to the interests of farmers. The homestead is not only the main place for peasants to live and entertain, but also carries many functions such as production, life, economy, culture and so on. As a result of our country to the homestead circulation restriction, caused a large number of homestead idle. In order to obtain benefits, driven by interests and driven by market demand, farmers promote the formation of the invisible circulation market of homestead, and trade the homestead in private, not only the interests of both sides of the transaction can not be protected. At the same time, it also damaged the interests of the village collective economic organizations. Homestead is a special land resource. The free circulation of Homestead can not only alleviate the shortage of land demand in the process of urbanization, but also improve the utilization rate of land and the value of land. Firstly, this paper puts forward the research background, summarizes the research trends of homestead management and circulation at home and abroad, and introduces the theory related to Homestead management. Secondly, taking Linfen City of Shanxi Province as the research object, the basic situation and utilization status of local homestead are summarized and empirically analyzed. Through the analysis of the problems in the process of homestead management: the first is the lack of relevant laws in the distribution link, resulting in the phenomenon of overstandard homestead everywhere; the second is the lack of clear property rights in the use of Homestead. Make the farmers' understanding of homestead use right is vague and the land utilization ratio is low. The third problem is that the current law of our country does not allow homestead transfer. However, the market demand for homestead is huge, thus promoting the formation of invisible circulation market, but invisible circulation market can not be protected by law, which has resulted in more and more disputes about homestead interests. The fourth is that the supervision is not in place; and concludes that there are many problems in the process of distribution, use, circulation and supervision of homestead, which are mainly due to the restriction of the free circulation of rural homestead in our country. And summarized the problems caused by restricting the circulation of rural homestead, mainly in the following aspects: first, aggravated the dual division of urban and rural areas; second, rural property rights were infringed; third, the land can not be used effectively; Fourth, invisible homestead transactions are rampant, resulting in a large number of property rights disputes. Finally, on the basis of research and analysis, the author puts forward the design ideas of the management system of the rural homestead in Linfen: first, to formulate relevant laws and regulations to regulate the distribution of rural homestead; The second is to improve the system of rural homestead registration, confirm the right to make the homestead property rights clear to ensure the rational use of rural homestead; third, supporting related systems to ensure the smooth circulation of homestead; fourth, strengthen supervision; The fifth is to start the pilot policy.
