【摘要】：農(nóng)地確權(quán)對(duì)農(nóng)戶(hù)生產(chǎn)性行為的影響受到學(xué)界廣泛重視,但現(xiàn)有文獻(xiàn)大多忽視了對(duì)確權(quán)所隱含的產(chǎn)權(quán)交易含義的研究。農(nóng)地確權(quán)在提升農(nóng)戶(hù)產(chǎn)權(quán)強(qiáng)度的同時(shí),有可能因土地的人格化財(cái)產(chǎn)特征而強(qiáng)化"稟賦效應(yīng)",并進(jìn)一步因"產(chǎn)權(quán)身份壟斷"與"產(chǎn)權(quán)地理壟斷"而加劇對(duì)經(jīng)營(yíng)權(quán)流轉(zhuǎn)的抑制。研究發(fā)現(xiàn),針對(duì)產(chǎn)權(quán)主體與產(chǎn)權(quán)客體不可分的交易約束,拓展科斯定理并通過(guò)產(chǎn)權(quán)細(xì)分、迂回交易及其有效匹配,能夠在尊重農(nóng)民土地人格化財(cái)產(chǎn)特征的前提下,實(shí)現(xiàn)農(nóng)業(yè)的規(guī)模經(jīng)濟(jì)與分工經(jīng)濟(jì)。進(jìn)一步的案例研究表明,以土地"集體所有、家庭承包、管住用途、盤(pán)活產(chǎn)權(quán)、多元經(jīng)營(yíng)"為主線(xiàn)的制度內(nèi)核,有可能成為中國(guó)新型農(nóng)業(yè)經(jīng)營(yíng)體系的基本架構(gòu)。
[Abstract]:The influence of farmland right on farmers' productive behavior has been paid more and more attention, but most of the existing literatures have ignored the research on the implied meaning of property right transaction. At the same time, it is possible to strengthen the "endowment effect" because of the personal property characteristics of the land, and further intensify the restriction on the circulation of the management right because of the "monopoly of the identity of property right" and the "geographical monopoly of the property right". It is found that in view of the transaction constraints between the subject and object of property rights, the Coase theorem can be extended and the property rights subdivision, circuitous transactions and their effective matching can be carried out on the premise of respecting the characteristics of the personified property of the peasants' land. Realize the scale economy of agriculture and division of labor economy. The further case study shows that the core of the system, which is the main line of land ownership, family contract, management, property rights and diversified management, is likely to become the basic framework of China's new agricultural management system.
