【摘要】:近年來(lái),隨著城市化進(jìn)程的不斷加快,土地供求矛盾的問(wèn)題越來(lái)越突出,而農(nóng)村集體經(jīng)營(yíng)性建設(shè)用地的入市交易能在一定程度上彌補(bǔ)城市建設(shè)用地供給不足的問(wèn)題。隨著十八屆三中全會(huì)提出建立城鄉(xiāng)統(tǒng)一的建設(shè)用地市場(chǎng),農(nóng)村集體經(jīng)營(yíng)性建設(shè)用地被賦予了出租、租賃、入股的權(quán)能,實(shí)行與國(guó)有土地同等入市、同權(quán)同價(jià)。在此背景下,集體經(jīng)營(yíng)性建設(shè)用地的入市交易成為學(xué)術(shù)界討論的熱點(diǎn)。目前,我國(guó)農(nóng)村集體建設(shè)用地交易出現(xiàn)諸多問(wèn)題,如自發(fā)、無(wú)序流轉(zhuǎn),土地范疇擴(kuò)大等,損害了農(nóng)村集體利益,導(dǎo)致土地資源低效配置。在這種情況下,通過(guò)搭建完備的入市交易平臺(tái)能夠有效的規(guī)范與指導(dǎo)土地交易行為,發(fā)揮專(zhuān)業(yè)機(jī)構(gòu)的優(yōu)勢(shì),進(jìn)而保障農(nóng)戶(hù)權(quán)益。本文第一部分在國(guó)外相關(guān)研究的基礎(chǔ)上,確定了本文的選題背景以及意義,然后以土地供求理論、政府壟斷市場(chǎng)理論、土地產(chǎn)權(quán)理論和委托代理理論為基礎(chǔ)進(jìn)行了相關(guān)分析。第二部分運(yùn)用案例分析、系統(tǒng)分析等方法對(duì)我國(guó)集體經(jīng)營(yíng)性建設(shè)用地的相關(guān)政策進(jìn)行了梳理,并以深圳、昆山、成都等為例分析目前我國(guó)的經(jīng)營(yíng)性建設(shè)用地的入市交易狀況及其存在的問(wèn)題。第三部分通過(guò)對(duì)美國(guó)、日本和法國(guó)的土地交易狀況進(jìn)行梳理,為構(gòu)建我國(guó)的農(nóng)村集體經(jīng)營(yíng)性建設(shè)用地交易平臺(tái)提供參考。第四部分對(duì)相關(guān)參與主體進(jìn)行博弈分析,通過(guò)分析提出對(duì)構(gòu)建交易平臺(tái)的建議。第五部分在國(guó)外交易平臺(tái)以及我國(guó)城市建設(shè)用地交易經(jīng)驗(yàn)的基礎(chǔ)上最終構(gòu)建了適應(yīng)我國(guó)國(guó)情的農(nóng)村集體經(jīng)營(yíng)性建設(shè)用地交易平臺(tái),分別進(jìn)行了制度構(gòu)建、交易平臺(tái)的搭建、交易平臺(tái)的功能及其運(yùn)行的說(shuō)明。第六部分為建立相關(guān)的配套設(shè)施提出了一些建議。最后一部分總結(jié)本文的研究結(jié)果,指出以后研究需改進(jìn)之處。
[Abstract]:In recent years, with the accelerating process of urbanization, the contradiction between land supply and demand is becoming more and more prominent, and the market entry transaction of rural collective management construction land can make up for the insufficient supply of urban construction land to a certain extent. As the third Plenary session of the 18th CPC Central Committee proposed the establishment of a unified construction land market in urban and rural areas, the rural collective management construction land has been given the power to lease, lease and invest shares, and to enter the market on the same basis as state-owned land and at the same price. Under this background, the market entry transaction of collective management construction land has become a hot topic in academic circles. At present, there are many problems in the transaction of rural collective construction land, such as spontaneous, disorderly circulation, expansion of land category and so on, which have damaged the collective interests of rural areas and resulted in inefficient allocation of land resources. In this case, through the establishment of a complete market entry trading platform can effectively regulate and guide land trading behavior, give play to the advantages of professional institutions, and then protect the rights and interests of farmers. The first part of this paper determines the background and significance of this topic on the basis of relevant studies abroad, and then based on land supply and demand theory, government monopoly market theory, land property rights theory and principal-agent theory. The second part uses the case analysis, system analysis and other methods to sort out the related policies of the construction land for collective management in our country, and take Shenzhen, Kunshan, Chengdu is an example to analyze the current situation and existing problems of commercial construction land in China. The third part through the United States, Japan and France to sort out the status of land transactions, for the construction of rural collective construction land trading platform to provide a reference. In the fourth part, the author makes a game analysis of the relevant participants, and puts forward some suggestions on the construction of the trading platform. In the fifth part, on the basis of the foreign trading platform and the experience of the urban construction land transaction in our country, the author finally constructs the rural collective management construction land transaction platform which is suitable for the national conditions of our country, and respectively carries on the system construction, the transaction platform construction. The function of the trading platform and the description of its operation. The sixth part puts forward some suggestions for the establishment of related facilities. The last part summarizes the results of this paper and points out that the future research needs improvement.
