【摘要】:十八屆三中全會(huì)“賦予農(nóng)民對土地承包經(jīng)營權(quán)擔(dān)保抵押權(quán)能”的提出,從國家的政策層面上放開了農(nóng)戶土地承包經(jīng)營權(quán)的抵押。農(nóng)戶土地承包經(jīng)營權(quán)抵押作為農(nóng)地流轉(zhuǎn)的重要形式,是最富研究意義的課題。承包經(jīng)營權(quán)抵押既能提供農(nóng)業(yè)發(fā)展所需的資金,又能促進(jìn)土地流轉(zhuǎn),對發(fā)展規(guī);r(nóng)業(yè)、提高土地利用效率具有重大意義。在尋求農(nóng)村發(fā)展困境出路的過程中,我國不少地區(qū)開展了土地承包經(jīng)營權(quán)抵押試點(diǎn),如福建明溪縣、四川崇州縣、江蘇太倉等地。然而轟轟烈烈的土地承包經(jīng)營權(quán)抵押實(shí)踐創(chuàng)新背后,風(fēng)險(xiǎn)重重。法律政策之間的沖突、市場的不完善等問題逐漸在試點(diǎn)顯現(xiàn)出來,提供資金融通的金融機(jī)構(gòu)的不積極參與,以及還未完全暴露出來的承包經(jīng)營權(quán)抵押違約帶來的糾紛也使得承包經(jīng)營權(quán)抵押的推行舉步維艱。及時(shí)發(fā)現(xiàn)土地承包經(jīng)營權(quán)抵押的風(fēng)險(xiǎn)并對風(fēng)險(xiǎn)防范化解,以使承包經(jīng)營權(quán)抵押順利推行成為現(xiàn)階段研究的重要問題。本文通過對取得一定成效的典型試點(diǎn)——福建明溪、四川崇州和江蘇太倉的土地承包經(jīng)營權(quán)抵押情況的分析,從國家法律政策、金融監(jiān)管、市場交易三個(gè)層面揭示風(fēng)險(xiǎn)因素。結(jié)合試點(diǎn)地區(qū)的土地承包經(jīng)營權(quán)抵押的經(jīng)驗(yàn),本文提出了風(fēng)險(xiǎn)防范化解的建議,即完善土地承包經(jīng)營權(quán)抵押的司法解釋、完善金融監(jiān)管制度、建立農(nóng)地抵押登記系統(tǒng)、構(gòu)建土地金融保險(xiǎn)制度、建立土地銀行,從而保證農(nóng)戶土地承包經(jīng)營權(quán)抵押的順利開展。
[Abstract]:The third Plenary session of the 18th CPC Central Committee put forward the idea of giving farmers the ability to guarantee the mortgage of the land contract management right, which liberalized the mortgage of the land contractual management right of the farmers from the national policy level. As an important form of farmland circulation, land contract management right mortgage is the most significant research topic. The mortgage of contractual management right can not only provide the funds needed for agricultural development, but also promote the circulation of land, which is of great significance to the development of large-scale agriculture and the improvement of land use efficiency. In the process of finding a way out of the predicament of rural development, many areas of our country have carried out land contract management right mortgage pilot projects, such as Minxi County in Fujian Province, Chongzhou County in Sichuan Province, Taicang County in Jiangsu Province and so on. However, the vigorous land contract management right mortgage innovation behind the risk. Conflicts between laws and policies, market imperfections and other problems have gradually emerged in the pilot projects, and financial institutions that provide financing have not been actively involved. And not yet fully exposed the contractual management rights mortgage default disputes also make the implementation of contractual management rights mortgage difficult. It is an important problem to find out the risk of land contract management right mortgage and to prevent and resolve the risk in order to make the contract management right mortgage carry out smoothly. Based on the analysis of some typical pilot projects in Minxi, Chongzhou and Taicang, Jiangsu Province, this paper reveals the risk factors from three aspects: national legal policy, financial supervision and market transaction. Combined with the experience of the land contract management right mortgage in the pilot area, this paper puts forward some suggestions to prevent and resolve the risk, that is, to perfect the judicial interpretation of the land contract management right mortgage, to perfect the financial supervision system, and to establish the farmland mortgage registration system. The system of land finance and insurance should be set up, and the land bank should be set up to guarantee the smooth development of the mortgage of land contract management right.
