【摘要】：集體與國(guó)有土地的產(chǎn)權(quán)構(gòu)造存在很大的不同,二者以什么路徑以及在多大程度上實(shí)現(xiàn)"同權(quán)同價(jià)"有其客觀規(guī)律性。本文梳理了"同權(quán)同價(jià)"的方法論邏輯,提出"同權(quán)同價(jià)"問(wèn)題研究需要從國(guó)有土地與集體土地的類比推論中擺脫出來(lái)。研究結(jié)果表明,"同權(quán)"問(wèn)題屬于物權(quán)法上的科學(xué)問(wèn)題,它有且只能指集體與國(guó)有建設(shè)用地使用權(quán)在法律性質(zhì)、物權(quán)種類和物權(quán)基本規(guī)格的同一。當(dāng)越出物權(quán)法,進(jìn)入公法層面,特別是當(dāng)進(jìn)入合同法的領(lǐng)域,"同權(quán)"的概念便蕩然無(wú)存;作為經(jīng)濟(jì)學(xué)上的"同價(jià)"問(wèn)題,其要義在于集體與國(guó)有土地遵循同樣的價(jià)格形成機(jī)制,而不可能指字面意義上的市場(chǎng)成交價(jià)相同或相近。
[Abstract]:The structure of property rights and collective owned land are very different, the two in what way and the extent to achieve the "right price" has its objective law. This paper reviews the methods of "right price" theory, put forward "on the right price" needs to emerge from the state-owned land and collective land. Analogy. Research results show that the "right" problem belongs to the scientific problems of property law, it can only refer to the collective and state-owned construction land use rights in the legal nature, property types and basic specifications of the same property. When a property law into public law, especially when entering the field of Contract Law the concept of "right", they all gone; as the economics of "price", its essence is the collective formation mechanism of state-owned land and follow the same price, and may refer to the literal meaning of the market price of the same or similar.
