【摘要】：近些年來,隨著城市化進(jìn)程的加快和鄉(xiāng)鎮(zhèn)企業(yè)的發(fā)展,對(duì)于農(nóng)村集體建設(shè)用地,尤其是城市周邊的農(nóng)村集體建設(shè)用地需求越來越旺盛,造成農(nóng)村集體建設(shè)用地自發(fā)、隱形的流轉(zhuǎn)十分嚴(yán)重,這種無序的流轉(zhuǎn)給國家土地管理工作帶來了很大的困難。土地不同于一般商品,土地問題是涉及到農(nóng)民的根本利益和國家穩(wěn)定發(fā)展的重大問題,適應(yīng)新形式的要求,在國家政策的支持下,很多地方政府對(duì)于農(nóng)村集體建設(shè)用地使用權(quán)的流轉(zhuǎn)進(jìn)行了試點(diǎn)工作,將其置于地方政府的管理和監(jiān)督之下,地方政府對(duì)農(nóng)村集體建設(shè)用地使用權(quán)流轉(zhuǎn)的監(jiān)管對(duì)于貫徹實(shí)施中央政府的政策命令,完善農(nóng)村集體建設(shè)用地流轉(zhuǎn)市場(chǎng),推動(dòng)其有序流轉(zhuǎn)至關(guān)重要。但是,我國目前農(nóng)村集體建設(shè)用地市場(chǎng)還不健全,由于市場(chǎng)失靈和政府失靈等原因,地方政府在對(duì)于農(nóng)村集體建設(shè)用地使用權(quán)流轉(zhuǎn)中的監(jiān)管也存在不少問題,還有很多需要完善之處。本文從四個(gè)方面對(duì)農(nóng)村集體建設(shè)用地使用權(quán)流轉(zhuǎn)中的地方政府監(jiān)管進(jìn)行了研究。首先對(duì)農(nóng)村集體建設(shè)用地使用權(quán)流轉(zhuǎn)中的地方政府監(jiān)管相關(guān)概念、流轉(zhuǎn)中地方政府監(jiān)管的主要要素、理論依據(jù)和意義進(jìn)行了闡述;其次闡釋了農(nóng)村集體建設(shè)用地使用權(quán)流轉(zhuǎn)中的地方政府監(jiān)管現(xiàn)狀,包括地方政府已經(jīng)取得的監(jiān)管成效、存在的問題及原因;最后從監(jiān)管依據(jù)、監(jiān)管主體、監(jiān)管內(nèi)容和方式(包括加強(qiáng)市場(chǎng)準(zhǔn)入主體監(jiān)管、強(qiáng)化價(jià)格監(jiān)管、嚴(yán)格數(shù)量監(jiān)管、革新收益分配監(jiān)管)三個(gè)方面提出了完善地方政府監(jiān)管的對(duì)策。
[Abstract]:In recent years, with the acceleration of urbanization and the development of township enterprises, the demand for rural collective construction land, especially the rural collective construction land around the city, has become more and more vigorous, resulting in the spontaneous use of rural collective construction land. The invisible circulation is very serious, this kind of disorderly circulation has brought great difficulty to the national land management work. The land is different from the general commodity, the land question is related to the farmer's fundamental interest and the national stable development important question. With the support of national policies, many local governments have carried out pilot work on the circulation of rural collective construction land use right and put it under the management and supervision of local governments. The supervision of the circulation of rural collective construction land use right by local governments is very important for carrying out the central government's policy order, perfecting the rural collective construction land circulation market and promoting the orderly circulation of rural collective construction land use right. At present, the rural collective construction land market is not perfect in our country. Due to market failure and government failure, there are many problems in the supervision of the circulation of rural collective construction land use right by local governments. This paper studies the local government supervision in the circulation of rural collective construction land use right from four aspects. First of all, the concept of local government supervision in the transfer of rural collective construction land use right is discussed. The main elements of local government supervision in the circulation, theoretical basis and significance are expounded. Secondly, the current situation of local government supervision in the transfer of rural collective construction land use right is explained, including the results of local government supervision. Finally, from the basis of supervision, the main body of supervision, the content and method of supervision (including strengthening supervision of market access, strengthening supervision of price, strict supervision of quantity, etc.). This paper puts forward the countermeasures of perfecting the supervision of local government in three aspects of innovating the regulation of income distribution.
