淺析農(nóng)村集體建設(shè)用地的流轉(zhuǎn)

【摘要】:城市化是一個(gè)國家經(jīng)濟(jì)發(fā)展和社會進(jìn)步到一定程度的必然結(jié)果和重要的參考物。隨著我國不斷推進(jìn)的城市和鄉(xiāng)鎮(zhèn)一體化,建設(shè)用地的需求與日俱增。但土地是稀缺的、不可再生的寶貴資源,是人民賴以生存和發(fā)展的重要生產(chǎn)要素。如何合理利用土地是當(dāng)今世界難題之一。出于保護(hù)耕地等政治目的,我國對建設(shè)用地一直實(shí)行嚴(yán)格管控,特別是限制農(nóng)村集體建設(shè)用地的自主流轉(zhuǎn)。雖然經(jīng)過多年的改革,在我國現(xiàn)行的法律框架內(nèi),對農(nóng)村土地承包經(jīng)營權(quán)的轉(zhuǎn)讓、抵押等已經(jīng)開放,但是對農(nóng)村集體建設(shè)用地的流轉(zhuǎn)卻仍然加以限制。由于城鎮(zhèn)人口的不斷增長,通過國家征收集體土地為國有土地后再出讓的方式,已經(jīng)不能滿足城市發(fā)展的用地的要求。大量農(nóng)村集體建設(shè)用地在沒有法律保障和政策支持的情況下自發(fā)流轉(zhuǎn)。在這一態(tài)勢之下,全國各地對農(nóng)村集體建設(shè)用地的流轉(zhuǎn)進(jìn)行試水,有關(guān)農(nóng)村集體建設(shè)用地的流轉(zhuǎn)方面的規(guī)范化文件如雨后春筍一般。在這一大背景下,中共中央、國務(wù)院出臺了一系列的文件,特別是黨的十八屆三中全會,確定了農(nóng)村集體經(jīng)營性建設(shè)用地與國有土地平等入市的方針。但是這些只是政策上的轉(zhuǎn)變。我國關(guān)于農(nóng)村集體建設(shè)用地的立法依然沒能改變。如果在農(nóng)村集體建設(shè)用地流轉(zhuǎn)過程中出現(xiàn)糾紛,各方的權(quán)益仍然得不到公平、合理的保障。而征收制度和農(nóng)村集體建設(shè)用地自主流轉(zhuǎn),好比硬幣的兩個(gè)面,隨著我國經(jīng)濟(jì)的發(fā)展,土地征收制度的弊端日益顯現(xiàn)。現(xiàn)階段農(nóng)村集體建設(shè)用地流轉(zhuǎn)中的亂象屢見不鮮。因此,農(nóng)村集體建設(shè)用地流轉(zhuǎn)的監(jiān)管、規(guī)范和法制勢在必行。
[Abstract]:Urbanization is the inevitable result of a country's economic development and social progress to a certain extent and an important reference material. With the continuous promotion of urban and township integration in China, the demand for construction land is increasing day by day, but land is scarce. Non-renewable precious resources are important factors of production for people's survival and development. How to make rational use of land is one of the difficult problems in the world today. In order to protect cultivated land and other political purposes, our country has been exercising strict control over construction land. In particular, restrictions on the autonomous circulation of rural collective construction land. Although after many years of reform, within the current legal framework of our country, the transfer of the right to contract management of rural land, mortgage and so on have been opened up. However, the circulation of rural collective construction land is still restricted. Due to the continuous growth of the urban population, the state expropriates collective land for state-owned land and then sells it. A large number of rural collective construction land has been transferred spontaneously without legal protection and policy support. Under this situation, the circulation of rural collective construction land has been tested in all parts of the country. Standardized documents on the circulation of rural collective construction land have sprung up. Against this background, the CPC Central Committee and the State Council issued a series of documents, especially the third Plenary session of the 18 CPC Central Committee. This paper determines the policy of equal access to the market of rural collective operating construction land and state-owned land. However, these are only changes in policy. The legislation on rural collective construction land in our country has not yet changed. If the rural collective construction land is built in rural areas, it can not be changed. Disputes arise in the course of the circulation of land for the establishment of land, The rights and interests of all parties are still not fairly and reasonably safeguarded. And the system of expropriation and the autonomous circulation of rural collective construction land are like two sides of coins. With the development of our economy, The malpractice of land expropriation system is becoming more and more obvious. At present, the disorder in the circulation of rural collective construction land is common. Therefore, the supervision, standardization and legal system of rural collective construction land circulation are imperative.
