【摘要】：始于二十世紀九十年代的農(nóng)地產(chǎn)權(quán)制度改革和土地征收制度改革,對農(nóng)民與政府兩大土地征收主體產(chǎn)生了重要影響,并使中央政府、地方政府、農(nóng)民之間的利益邊界、權(quán)力和權(quán)利邊界在制度變遷下發(fā)生顯著變化。同時,在制度變遷影響下,作為征地沖突發(fā)生場域,國家對農(nóng)村社會的控制由強變?nèi)�、基層政府轉(zhuǎn)變?yōu)椤皯腋⌒汀闭䴔?quán),使得鄉(xiāng)村場域呈現(xiàn)出正式治理與非正式治理并存、鄉(xiāng)村權(quán)威多元化的新特點,并導致在這一特殊場域中進行博弈的各個群體之間行動邊界交疊。邊界變化背景下的邊界沖突誘發(fā)了政府與農(nóng)民、農(nóng)民內(nèi)部各群體之間多種形態(tài)的征地沖突,政府與農(nóng)民之間的征地沖突形態(tài)主要包括圍繞征地補償款、土地增值收益等實體性利益的沖突,以及征地知情權(quán)、參與權(quán)等程序性利益的沖突;農(nóng)民群體內(nèi)部沖突形態(tài)主要是村集體與村成員就補償款分配的沖突,被征地農(nóng)民、未被征地農(nóng)民、有成員權(quán)但無承包地農(nóng)民間的沖突。邊界沖突誘發(fā)的征地沖突一方面造成各種形態(tài)博弈的多發(fā),另一方面透視出征地沖突的治理困境:利益邊界模糊導致征地沖突化解基礎薄弱、權(quán)力和權(quán)利邊界沖突導致征地沖突易升級、行動邊界交疊導致征地沖突暴力化。因此,要通過構(gòu)建市場型征地制度、改革土地增值收益的分配方式,廓清各主體利益邊界;加強征地立法建設、重塑農(nóng)民和政府角色,使權(quán)力和權(quán)利邊界清晰化;重構(gòu)農(nóng)民話語權(quán)、重塑征地程序、約束征地參與主體行為,實現(xiàn)征地博弈規(guī)范化。
[Abstract]:The reform of farmland property right system and land expropriation system, which began in 1990s, has had an important impact on the two main bodies of land expropriation, namely, farmers and the government, and has made the central government and local governments. At the same time, under the influence of institutional change, as the field of land expropriation conflict, the state control over the rural society has changed from strong to weak. The transformation of grass-roots government into "suspended" regime makes the rural field show the new characteristics of formal governance and informal governance, and the diversification of rural authority. And it leads to the overlapping of the action boundaries between the different groups in this special field. The border conflict under the background of the boundary change induces many kinds of land expropriation conflicts between the government and the farmers and among the groups within the farmers. The conflict forms of land expropriation between the government and farmers mainly include the conflicts of substantive interests, such as compensation for land requisition, land value-added income and so on, as well as the conflicts of procedural interests such as the right to know and participate in land requisition. The internal conflict form of the peasant group is mainly the conflict between the village collective and the members of the village on the distribution of compensation money, the peasants who have been expropriated, but the peasants who have not been expropriated. The conflicts between peasants with the right of membership but without contracted land. On the one hand, the conflicts of land expropriation caused by the border conflicts lead to various forms of game. On the other hand, it is difficult to deal with the conflict of land expropriation because of the ambiguity of interest boundary, and the conflict of power and right leads to the conflict of land expropriation easy to escalate. The overlapping of operational boundaries leads to the violent conflict of land expropriation. Therefore, it is necessary to reform the distribution mode of land value-added gains by constructing market-based land expropriation system so as to clarify the interests boundary of various subjects. Strengthen the construction of land expropriation legislation, reshape the role of farmers and government, and make the boundary of power and rights clear; Reconstruction of peasants' right to speak, remolding the procedure of land requisition, restricting the behavior of land requisition to participate in the main body, realizing the standardization of land expropriation game.
