遼寧省土地評估機構的風險管理研究

【摘要】:我國的土地評估行業(yè)起步于1992年,發(fā)展至今不過短短的二十幾年,但在這二十幾年里卻經(jīng)歷了行業(yè)的三次改革,每一次改革后,土地評估機構面臨的風險都不盡相同。隨著近兩年來,土地評估機構和評估人員涉及訴訟的案件逐漸增多,部分土地估價師不得不接受民事賠償、行政處罰甚至刑事處罰,大家開始意識到土地評估行業(yè)的風險不但不低于其他評估行業(yè),而且與其他評估行業(yè)相比還有其自身的特殊性。另外,2016年《中華人民共和國資產(chǎn)評估法》實施后,評估機構在新的法律環(huán)境下又將面臨不一樣的風險。本文首先對研究背景、研究意義和研究目的進行了闡述;從對所研究內(nèi)容的概念、理論入手,在綜合借鑒國內(nèi)外已有研究、查閱案例、問卷調(diào)查的基礎上,分析了現(xiàn)階段遼寧省土地評估機構的現(xiàn)狀,將土地評估風險分為系統(tǒng)風險和個別風險兩類,其中個別風險又分為經(jīng)營風險、管理風險和技術風險。通過對遼寧省土地估價師協(xié)會的走訪調(diào)查,對各機構調(diào)查問卷的統(tǒng)計分析,結合相關理論,對土地評估中可能存在的各類風險進行辨識和評估,分別提出了管理措施,并針對土地評估的特點,提出采用分解工作程序來控制管理風險的方案。經(jīng)過對土地評估機構工作流程及土地評估業(yè)務的深入研究,設計了針對土地評估的“七步工作法”,明確了每一步的工作內(nèi)容和工作程序后,分析每一步工作中可能遇到的風險,針對風險特征,提出解決方案和建議,最終實現(xiàn)控制風險的目的。土地評估涉及時間較長、工作步驟多、涉及的知識面廣,不同地區(qū)評估機構的風險也會有所不同,由于篇幅所限,本文僅從遼寧省土地評估機構目前普遍存在的風險進行了進行考慮,難免對一些特殊情況有所遺漏。后續(xù)可以進一步加強這方面的研究。
[Abstract]:China's land valuation industry started in 1992, has developed for just a short period of twenty years, but in the past 20 years has experienced three reforms of industry, every time after the reform, facing the risk of land assessment agencies are not the same as the past two years, land assessment agencies and assessment personnel involved in litigation the cases increased gradually, part of the land valuers have to accept civil compensation, administrative punishment or criminal penalties, we began to realize that the risk of land assessment industry is not only lower than the other appraisal industry, and also has its own particularity compared with other assessment industry. In addition, 2016 "People's Republic of China asset appraisal law" after the implementation of assessment agencies in law the new environment will face the risk of not the same. This paper first introduces the research background, research significance and research are described; from the concept of research content In the case, theory, access to comprehensive home and abroad research, and on the basis of the survey, the paper analyzes the present situation of Liaoning province land assessment agencies, land risk assessment is divided into system risk and individual risk two categories, which are divided into individual risk management risk, management risk and technical risk through. Investigation on land valuers Association of Liaoning Province, a statistical analysis of the questionnaire survey agencies, combined with relevant theory, identification and assessment of risks may exist in land evaluation, respectively put forward management measures, and according to the characteristics of land evaluation, the decomposition of the work program to control the risk management plan. Through in-depth study on the mechanism of the work flow and the assessment of land business assessment for land, land is designed for assessment of the "seven step method", the every step of the work content and work process Order, risk analysis of each step in the work, according to the risk characteristics, put forward solutions and suggestions, finally achieve the purpose of risk control. The land assessment involves a long time, the work of many steps, covers a wide range of knowledge, risk assessment agencies in different regions will be different, because of the limited space, this paper only from the risk of Liaoning province land assessment agencies present are considered, there are missing for some special cases. The follow-up can further strengthen the research in this area.
