【摘要】：土地流轉(zhuǎn)問題一直是我國政府及社會各界關(guān)注的重點(diǎn)。近兩年來黨中央、國務(wù)院多次發(fā)布關(guān)于土地流轉(zhuǎn)政策的相關(guān)文件,其中影響力最大的是2015年11月份發(fā)布的《深化農(nóng)村改革綜合性實(shí)施方案》,該方案強(qiáng)調(diào)了集體所有權(quán)落實(shí)、穩(wěn)定農(nóng)戶承包權(quán)、放活土地經(jīng)營權(quán)等內(nèi)容。在2016年11月,黨中央國務(wù)院又發(fā)布的《關(guān)于完善農(nóng)村土地所有權(quán)承包權(quán)經(jīng)營權(quán)分置辦法的意見》明確規(guī)定了土地確權(quán)辦法。由此可見,政府在農(nóng)村土地流轉(zhuǎn)上的政治職能已發(fā)揮的越來越完善。然而,隨著農(nóng)村向工業(yè)化、城鎮(zhèn)化的深入發(fā)展,大量農(nóng)業(yè)人口向城市轉(zhuǎn)移,以往小農(nóng)經(jīng)營模式下的耕地得不到有效的利用而使得土地和人口矛盾進(jìn)一步激化。作為土地資源的直接管理者,基層政府如何整合資源、合理利用土地,怎樣進(jìn)行土地改革、更好的實(shí)現(xiàn)農(nóng)村土地流轉(zhuǎn)已逐漸被各地政府提為重要日程。本文將對我國基層政府在農(nóng)村土地流轉(zhuǎn)中的職能履行進(jìn)行研究,結(jié)合2017年最新土地確權(quán)政策和全國兩會中提及的土地流轉(zhuǎn)相關(guān)內(nèi)容,闡述基層政府參與土地流轉(zhuǎn)的原因、現(xiàn)狀、偏差及之后的主要職能履行。因?yàn)槲覈幵谕恋馗母锏倪^渡性階段,所以基層政府在農(nóng)村土地流轉(zhuǎn)中的職能也需要隨著土地確權(quán)等政策進(jìn)一步優(yōu)化。目前政府職能偏差主要體現(xiàn)在對土地流轉(zhuǎn)市場的監(jiān)督和管理上,包含基層政府強(qiáng)行推動土地流轉(zhuǎn)、土地流轉(zhuǎn)監(jiān)督法律不健全和政府內(nèi)部官員的監(jiān)管不當(dāng)?shù)葐栴}。綜合之前相關(guān)學(xué)者的研究和我國農(nóng)村實(shí)際土地流轉(zhuǎn)的相關(guān)數(shù)據(jù),認(rèn)為應(yīng)更加注重基層政府監(jiān)督、管理、引導(dǎo)和服務(wù)這四項(xiàng)職能的綜合性發(fā)揮。只有充分執(zhí)行基層政府的協(xié)助管理職能,完善土地流轉(zhuǎn)的價值評估和監(jiān)督機(jī)制,建立更加全面的土地流轉(zhuǎn)工作程序和相關(guān)制度執(zhí)行模式,才能切實(shí)保障農(nóng)民的個人利益,促進(jìn)農(nóng)業(yè)經(jīng)濟(jì)水平的發(fā)展。
[Abstract]:The issue of land circulation has been the focus of our government and the community. In the past two years, the Party Central Committee and the State Council have issued many documents on land transfer policy. One of the most influential is the "Comprehensive implementation Plan for deepening Rural Reform" issued in November 2015, which emphasizes the implementation of collective ownership and stability of farmers' right to contract. Release of land management rights and other content. In November 2016. The Party Central Committee and the State Council also issued "on the improvement of the rural land ownership right of management of the separate management of the measures" clearly defined the right to confirm the land method, so it can be seen. The political function of the government in the rural land circulation has been playing more and more perfect. However, with the further development of industrialization and urbanization, a large number of agricultural population has been transferred to the city. As the direct manager of land resources, the grass-roots government how to integrate resources and make rational use of land because of the lack of effective use of arable land under the management mode of small farmers in the past, which further intensifies the contradiction between land and population. How to carry out land reform and better realize rural land transfer has been gradually put forward as an important agenda by local governments. This paper will study the function of grass-roots government in rural land transfer. Combined with the latest policy of confirming land rights in 2017 and the relevant contents of land circulation mentioned in the national two sessions, this paper expounds the reasons and current situation of grass-roots governments participating in land circulation. Deviation and subsequent performance of the main functions. Because our country is in the transitional stage of land reform. So the functions of grass-roots government in the rural land transfer also need to be further optimized with the land confirmation policy. At present, the deviation of government function is mainly reflected in the supervision and management of the land transfer market. Including grass-roots government forced the promotion of land circulation, land circulation supervision law is not perfect and government officials improper supervision and other issues. Synthesis of previous relevant scholars and rural land circulation related data. Should pay more attention to grass-roots government supervision, management, guidance and service of these four functions of comprehensive play, only to fully implement the grass-roots government to assist the management function, improve the value of land circulation evaluation and supervision mechanism. Only by establishing a more comprehensive working procedure of land circulation and implementing mode of related system can the individual interests of farmers be protected and the development of agricultural economy level be promoted.
