【摘要】：針對“三農(nóng)問題”，李克強總理在2015年全國兩會的政府工作報告中對土地改革問題做出了重要批示，李克強總理指出土地確權登記頒證工作要認真對待、確保各項工作實施到位，集體產(chǎn)權制度要周密而慎重的發(fā)展，除此之外對于農(nóng)村土地的征用，宅基地制度的改革，以及如何將集體土地中的經(jīng)營性建設用地推向地產(chǎn)交易市場等等一系列工作都要審慎的推進。在經(jīng)濟發(fā)展的過程中，要切實守住耕地紅線，不僅要保證耕地數(shù)量不能減少，更要保證耕地質(zhì)量不下降，從而使農(nóng)民的利益得到保障。土地的使用應該主張并遵循節(jié)約集約的的規(guī)定，城市和農(nóng)村的建設用地應該統(tǒng)一納入到一個市場體系中并遵循穩(wěn)健妥善的方針去開展建設。 伴隨著城市化進程的快速推進，我國正經(jīng)歷著人口城鎮(zhèn)化以及土地城鎮(zhèn)化，其中土地城鎮(zhèn)化更快于人口城鎮(zhèn)化的發(fā)展。根據(jù)我國有關機構的一項摸底調(diào)查報告顯示，2013年我國城市新區(qū)范圍內(nèi)每多出來1300萬的人口數(shù)量就會使我國城鎮(zhèn)化率提高百分之一，人口的發(fā)展進而會增加對于土地的需求，這一需求大約是200萬畝。 良好的土地政策的核心是土地，尤其在當今新型城鎮(zhèn)化的時代背景下，良好的土地政策對經(jīng)濟社會的全面健康發(fā)展具有積極正面的促進作用，人類社會生產(chǎn)生活最根本、最基本的制度就是土地制度。而土地流轉(zhuǎn)問題則是重中之重。目前土地流轉(zhuǎn)已經(jīng)出現(xiàn)一些問題、矛盾，甚至非常嚴重，農(nóng)地被政府部門征收后，農(nóng)民并不能享受到相關的權益保障，導致農(nóng)民與政府、企業(yè)出現(xiàn)對立的現(xiàn)象。土地流轉(zhuǎn)最根本的是保障農(nóng)民的權益，因為土地歸農(nóng)民集體所有，流轉(zhuǎn)與否，價格高低，，本應由農(nóng)民掌握主動權，而事實情況恰恰相反，土地流轉(zhuǎn)市場一直由國家主導，農(nóng)民并不能準確的知道土地該以何種價格出售是合理的，政府與農(nóng)民之間的信息嚴重不對稱。中華人民共和國《節(jié)約集約利用土地規(guī)定》指出應將價格杠桿和土地租金等市場配置工具應用并且結合到各類有償使用的土地供應中，使土地的使用狀況得到促進、優(yōu)化。因此關于土地定價的相關問題亟待解決。 本文通過對各種傳統(tǒng)定價方法進行比較，分析指出存在的缺陷以及不合理之處，其中最普遍采納的資本化法以及征地區(qū)片法都未能將土地的或有收益考慮在內(nèi)。土地在流轉(zhuǎn)出讓過程中，不僅僅要考慮土地被用于種植農(nóng)作物所獲得的收益，更要考慮土地作為其他活動載體所具有的或有價值，這種或有價值我們便視為期權價值，因此土地價值應包括確定性的種植收益產(chǎn)生的價值以及不確定性的或有價值兩部分。對比土地及房屋的價格指數(shù)，我們發(fā)現(xiàn)兩者的相關性極高，因此將土地看做是以房屋價格為標的資產(chǎn)的美式看漲期權。通過選取幾組無風險利率、預期收益率和波動率的不同數(shù)據(jù)的組合，對期權價值和土地價值進行計算比較，期權價值在土地價值的構成中占據(jù)了50%以上。我們又選取了中國市場的參數(shù)進行計算，得出采用資本化法得到的價值不足土地總價值的三分之一，也就是說我國目前的土地定價方法將農(nóng)民的權益蒸發(fā)了一半以上。文章的分析對不斷完善我國的土地定價以及征地補償?shù)裙ぷ骶哂袑嶋H的指導意義。
[Abstract]:In the process of economic development , it is necessary to ensure that the quantity of cultivated land cannot be reduced and the quality of the cultivated land is not reduced , so as to ensure that the quality of the cultivated land is not reduced , so that the interests of the peasants can be guaranteed . Along with the rapid advancement of urbanization , our country is experiencing the urbanization of the population and the urbanization of the land , in which the urbanization of the land is faster than the development of the urbanization of the population . According to a survey report of the relevant institutions of our country , the amount of the population of 13 million in 2013 will increase the urbanization rate of our country by one percent , and the development of the population will increase the demand for land , which is about 2 million mu . The core of good land policy is the land , especially in the background of the new urbanization , good land policy plays a positive role in the comprehensive and healthy development of economy and society , and the most basic system is land system . Compared with traditional pricing methods , this paper analyzes the existing defects and unreasonable places , the most commonly adopted capitalization method and the land value method have failed to take the land ownership or benefit into consideration . The land value should include the value of certainty and the value of the land value . Therefore , the land value should include the value of the certainty and the value of the land value .
