【摘要】：農(nóng)村土地流轉(zhuǎn)歸根到底流轉(zhuǎn)的是土地的使用權(quán)流轉(zhuǎn),農(nóng)村土地的承包經(jīng)營(yíng)權(quán)是不流轉(zhuǎn)的,仍然屬于農(nóng)民自身。農(nóng)民是將其擁有土地承包經(jīng)營(yíng)權(quán)的耕地按照有關(guān)約定流轉(zhuǎn)給承包商。盡管每年農(nóng)村土地流轉(zhuǎn)的總體規(guī)模在逐步擴(kuò)大,但是絕大多數(shù)地區(qū)的農(nóng)村土地流轉(zhuǎn)率并不高。主要是非農(nóng)收入不穩(wěn)定、保障體系不完善、流轉(zhuǎn)程序不規(guī)范、土地市場(chǎng)不健全、規(guī)模經(jīng)營(yíng)缺資金等因素限制了農(nóng)地的正常流轉(zhuǎn)。武漢城市圈農(nóng)村土地流轉(zhuǎn)同樣存在上述問(wèn)題,但也呈現(xiàn)出流轉(zhuǎn)意愿不強(qiáng)烈、流轉(zhuǎn)土地不集中、流轉(zhuǎn)程序不規(guī)范和保障體系不完善等特點(diǎn)。在借鑒國(guó)內(nèi)外相關(guān)優(yōu)秀研究成果的基礎(chǔ)上,通過(guò)對(duì)武漢市城市圈里有代表意義的鄉(xiāng)鎮(zhèn)進(jìn)行實(shí)地調(diào)研,借此來(lái)研究武漢城市圈里農(nóng)村土地流轉(zhuǎn)的一些情況,研究目前土地流轉(zhuǎn)所涉及的一系列問(wèn)題。尋找其產(chǎn)生的原因和背景,從而對(duì)癥下藥地提出解決建議和對(duì)策。在現(xiàn)有土地流轉(zhuǎn)的常見模式下,對(duì)出租、轉(zhuǎn)包、轉(zhuǎn)讓、互換和入股等現(xiàn)有的一些基本形式進(jìn)行融合,在考慮到農(nóng)戶的基本要求和武漢市城市圈土地的實(shí)際情況下,建議在繼續(xù)采取轉(zhuǎn)包、出租和入股等初級(jí)模式的基礎(chǔ)上,創(chuàng)新或演化出“土地銀行模式”和“土地股份制流轉(zhuǎn)模式”。同時(shí),武漢城市圈的土地流轉(zhuǎn)應(yīng)通過(guò)加大政策支持力度,完善相關(guān)法律法規(guī),建立統(tǒng)一圈內(nèi)流轉(zhuǎn)市場(chǎng),使各項(xiàng)權(quán)能體系更加規(guī)范,完善社會(huì)保障制度,以保障土地流轉(zhuǎn)的雙方達(dá)成共識(shí),不存在后顧之憂。也使得土地資源得到更好的利用,更好的滿足武漢城市圈“兩型”社會(huì)的發(fā)展需求。
[Abstract]:The circulation of rural land in the final analysis is the transfer of land use rights, rural land contractual management right is not circulation. Farmers still belong to the farmers themselves. Farmers transfer the farmland they own the land contract management right to the contractor according to the relevant agreement, although the overall scale of the rural land circulation is gradually expanding every year. But most of the rural land transfer rate is not high, mainly non-agricultural income instability, security system is not perfect, circulation procedures are not standard, land market is not perfect. The scale management lack of funds and other factors limit the normal circulation of agricultural land. Wuhan urban circle rural land circulation also exists the above problems, but also shows that the transfer will is not strong, circulation land is not centralized. Flow procedures are not standardized and the security system is not perfect and so on. On the basis of reference of domestic and foreign outstanding research results, through the Wuhan city circle has representative significance of the township field investigation. In order to study the situation of rural land circulation in Wuhan urban circle, the paper studies a series of problems involved in the current land circulation, and looks for the causes and background of the land circulation. In the light of the common mode of land circulation, some basic forms of leasing, subcontracting, transfer, swap and equity acquisition are merged. In consideration of the basic requirements of farmers and the actual situation of Wuhan urban area land, it is proposed to continue to take subcontracting, leasing and equity acquisition and other primary models on the basis. Innovation or evolution of "land banking model" and "land shareholding circulation model". At the same time, Wuhan urban area land circulation should be through increasing policy support, improve the relevant laws and regulations. Establish a unified circulation market within the circle, make the power system more standardized, improve the social security system, in order to ensure that both sides of the land transfer reached a consensus, there is no worry behind, but also make better use of land resources. Better meet the Wuhan City Circle "two-type" social development needs.
