【摘要】：自古以來,農(nóng)業(yè)興則百業(yè)興,農(nóng)民富則社會(huì)富。土地問題是我國“三農(nóng)”問題中最基礎(chǔ)的問題,我國農(nóng)村中的各項(xiàng)制度是建立在土地制度的基礎(chǔ)上的。當(dāng)前,農(nóng)村最基本的生產(chǎn)資料是土地,土地仍擔(dān)負(fù)著提高農(nóng)民收入水平、為農(nóng)民提供就業(yè)和生活保障的使命。農(nóng)村土地流轉(zhuǎn)在我國已經(jīng)得到了廣泛的實(shí)施和推廣,它在農(nóng)村家庭承包責(zé)任制基礎(chǔ)上得到了一定的創(chuàng)新和發(fā)展,彌補(bǔ)了家庭承包責(zé)任制深層缺陷。本文以科技園辦事處的土地流轉(zhuǎn)現(xiàn)狀為案例,對(duì)國內(nèi)外學(xué)者的研究進(jìn)行綜述的基礎(chǔ)上,首先對(duì)國內(nèi)土地流轉(zhuǎn)的現(xiàn)狀和問題進(jìn)行了歸納分析。然后通過實(shí)地調(diào)查,對(duì)本地區(qū)土地流轉(zhuǎn)工作進(jìn)行了大量的實(shí)證研究,主要是對(duì)本地區(qū)土地流轉(zhuǎn)存在的問題、制約因素進(jìn)行分析研究。通過調(diào)查分析發(fā)現(xiàn),該地區(qū)土地流轉(zhuǎn)涉及到群眾意愿、現(xiàn)行的制度、法律、政策層面、服務(wù)機(jī)制、市場(chǎng)不健全等等一系列的問題。造成這些問題的主要因素是傳統(tǒng)思想的制約,土地相關(guān)法律的不健全,產(chǎn)權(quán)制度的不完整及農(nóng)村社會(huì)保障體系建設(shè)的滯后等。通過歸納對(duì)比我國當(dāng)前各地土地流轉(zhuǎn)的典型模式,參照當(dāng)前國內(nèi)其他地區(qū)的先進(jìn)經(jīng)驗(yàn),找出差距并提出推進(jìn)土地流轉(zhuǎn)工作的四點(diǎn)對(duì)策和建議,分別是加強(qiáng)宣傳引導(dǎo)、完善社會(huì)保障體系,規(guī)范流轉(zhuǎn)過程和加大扶持力度,這對(duì)于完善我國農(nóng)村土地流轉(zhuǎn)制度,推動(dòng)土地有序合理流轉(zhuǎn)有一定的啟示。
[Abstract]:Since ancient times, village is steady, rich farmers are rich. The land issue is the social basis of China's "three rural issues" problems in the system of China's rural land system is based on the. Currently, the most basic means of production in rural land, land is still responsible for increasing the income of farmers the level of employment and social security for the mission of farmers. The rural land circulation has been implemented and widely used in our country, it has certain innovation and development based on the rural household contract responsibility system, make up the family contract responsibility system. Based on the deep defects in the current situation of land circulation in the office for science and technology park the case, summarized the research of scholars at home and abroad, summarizes first the analysis of the status quo and problems of domestic land transfer. Then through the field survey, as of industrial land transfer region A large number of empirical research, mainly on the existence of land circulation in the region, analysis of the restricting factors. Through investigation and analysis, the land circulation in the region related to the wishes of the masses, the current system of law, policy, service mechanism, the market is not perfect and so on a series of problems caused by the main factors of these problems. Is the restriction of the traditional ideas, land related law is not perfect, property rights system is not complete and the construction of rural social security system lags behind. Typical patterns by inductive and comparative current around the land circulation, referring to the advanced experience of the other parts of the country, to find out the gap and puts forward four countermeasures and suggestions to promote land circulation work respectively, is to strengthen publicity and guidance, improve the social security system, standardize the transfer process and increase support for the improvement of Chinese rural land transfer system, promote soil The rational circulation of the land has some enlightenment.
