【摘要】：我國土地所有權(quán)屬于國家和集體所有,切實保障農(nóng)民的土地承包經(jīng)營權(quán)是對農(nóng)民根本權(quán)益的保障。文章從土地承包經(jīng)營權(quán)取得制度角度,分析建國后原始取得制度存在的問題;提出原始取得主體不明確,應(yīng)借鑒表見代理制度擴大原始取得制度中發(fā)包方的范圍。對于原始取得的公示方式,應(yīng)采用登記要件主義,區(qū)別于《土地登記辦法》中的土地登記程序,明確規(guī)定由發(fā)包方進行登記申請。
[Abstract]:The ownership of land in our country belongs to the state and collectives. It is the guarantee of farmers' fundamental rights and interests to ensure the farmers' right to contract management of land. Analyze the problems existing in the original acquisition system after the founding of the people's Republic of China; The author points out that the original acquisition subject is not clear, we should use the apparent agency system to expand the scope of the original acquisition system, and the registration elements doctrine should be adopted for the original acquisition publicity mode. Different from the land registration procedure in the Land Registration method, it is clearly stipulated that the contracting party shall apply for registration.
