【摘要】：戶外運動是一組以自然環(huán)境為場地（非專用場地）的帶有探險性質(zhì)或體驗探險的體育項群。戶外運動在上個世紀80年代從歐美進入我國，它在提升人們身體素質(zhì)、心理素質(zhì)和團隊協(xié)作精神上有著不可替代的作用。戶外運動在我國迅速發(fā)展的同時，安全意識、法律法規(guī)、救援體系、保險制度、戶外運動參與者自身素質(zhì)等諸多問題，引起全社會的高度關(guān)注，尤其是公眾戶外運動中傷害事故的責任問題，已成為亟待研究的重要課題。對其研究，對推動戶外運動法律法規(guī)建設(shè)和戶外運動實踐具有重要的意義：它是戶外運動相關(guān)立法、司法仲裁的迫切需要；通過分析戶外運動中的責任問題，對立法和司法實踐提供具體建議；可以預防事故與糾紛的發(fā)生和保障戶外運動參與者的權(quán)益。 本文以發(fā)生在我國的戶外運動傷害事故為主要的研究對象。通過面談、電話和網(wǎng)絡視頻的聯(lián)系方式，對部分戶外運動俱樂部負責人，部分律師事務所律師、以及法學專家進行了訪談。問卷調(diào)查范圍涉及12個省、自治區(qū)、直轄市，共獲得有效問卷214份，對調(diào)查問卷進行了基本的統(tǒng)計，結(jié)合文獻資料法、案例分析法以及邏輯分析法，從理論和實踐兩方面進行研究。 戶外運動中傷害事故的責任認定，主要從戶外運動傷害事故的原因包括三類12個原因、組織者和參與者的權(quán)利、義務以及歸責原則方面進行研究，并通過案例分析戶外運動傷害事故中各方的責任，最后分析了學界存在爭議的自冒風險是不是抗辯和免責事由以及免責聲明能不能免責。戶外運動傷害事故的賠償問題，根據(jù)我國現(xiàn)有的法律法規(guī)，從戶外運動傷害事故賠償責任的四個要件、賠償?shù)脑V訟或調(diào)解、賠償?shù)姆秶约皯敉膺\動中傷害事故是否應包括精神損害賠償幾個方面加以闡述。在理論研究和訪談的基礎(chǔ)上，對戶外運動中傷害事故責任問題從法律法規(guī)、保險制度、安全預警制度、救援體系、行業(yè)協(xié)會等五個方面的提出應對策略。據(jù)此，本文探討有關(guān)戶外運動的法律問題，加強和完善我國戶外運動的立法，合理規(guī)避戶外運動中有風險責任，減少戶外運動的糾紛，重視戶外運動的安全防范對策。
[Abstract]:Outdoor sports is a group of sports events with the nature of adventure or experience adventure, which takes the natural environment as the venue (non-special site). Outdoor sports entered our country from Europe and America in -20s, it is improving people's physical quality. Psychological quality and teamwork spirit play an irreplaceable role. With the rapid development of outdoor sports in China, there are many problems such as safety awareness, laws and regulations, rescue system, insurance system, quality of outdoor sports participants, etc. The whole society pays close attention to it, especially the responsibility of injury accidents in public outdoor sports, which has become an important subject to be studied. It is of great significance to promote the construction of outdoor sports laws and regulations and outdoor sports practice: it is the urgent need of outdoor sports related legislation, judicial arbitration, through the analysis of outdoor sports in the issue of responsibility, It can prevent accidents and disputes and protect the rights and interests of outdoor sports participants. This article takes the outdoor sports injury accident in our country as the main research object. Through the contact information of interview, telephone and network video, the author gives some outdoor sports club leaders, some law firms lawyers, The questionnaire covers 12 provinces, autonomous regions and municipalities directly under the Central Government. A total of 214 valid questionnaires were obtained. The basic statistics of the questionnaires were carried out, including literature, case analysis and logic analysis. From the theoretical and practical aspects of the study. The responsibility of injury accident in outdoor sports is determined, mainly from the causes of outdoor sports injury accident including three types of 12 reasons, the rights, obligations and imputation principles of organizers and participants. And through the case analysis of the responsibility of the parties in outdoor sports injury accident, finally analyzed the academic controversy whether the self-risk is the defense and disclaimer, as well as whether the disclaimer can be disclaimed.Outdoor sports injury accident compensation problem, According to the existing laws and regulations of our country, from the four elements of compensation liability for outdoor sports injury accident, compensation litigation or mediation, The scope of compensation and whether the injury accident in outdoor sports should include compensation for mental injury are expounded. Based on the theoretical research and interviews, the liability of injury accidents in outdoor sports is discussed in terms of laws and regulations, insurance system, According to the five aspects of safety early warning system, rescue system, trade association and so on, this paper discusses the legal problems of outdoor sports, strengthens and consummates the legislation of outdoor sports in our country. Avoid the risk responsibility in outdoor sports reasonably, reduce the disputes of outdoor sports, and attach importance to the safety prevention countermeasures of outdoor sports.
