【摘要】：宅基地是農(nóng)村土地的重要組成部分,是農(nóng)民權(quán)益最重要的保障,宅基地對(duì)保障農(nóng)民的居住權(quán)至關(guān)重要,而在當(dāng)前城鎮(zhèn)化的推進(jìn)下,宅基地對(duì)農(nóng)民的意義更加重大。我國(guó)當(dāng)前城鎮(zhèn)化的發(fā)展對(duì)土地的需求擴(kuò)大,農(nóng)民可以通過(guò)宅基地退出獲得相應(yīng)的財(cái)產(chǎn)性收益。但是我國(guó)當(dāng)前的宅基地制度只賦予農(nóng)民使用權(quán),原則上農(nóng)民要無(wú)償退出宅基地,這大大降低了農(nóng)民退出宅基地的積極性,可見(jiàn)我國(guó)當(dāng)前的宅基地制度已遠(yuǎn)遠(yuǎn)滯后于經(jīng)濟(jì)社會(huì)的發(fā)展。當(dāng)前國(guó)內(nèi)一些地區(qū)在宅基地的利用上已經(jīng)取得了成功經(jīng)驗(yàn),通過(guò)借鑒試點(diǎn)地區(qū)的經(jīng)驗(yàn),完善我國(guó)的宅基地制度,并因地制宜,構(gòu)建農(nóng)村宅基地的退出機(jī)制,可以有效整合農(nóng)村宅基地,并節(jié)約大量的土地資源,為我國(guó)城鎮(zhèn)化的推進(jìn)提供巨大動(dòng)力。本文通過(guò)對(duì)試點(diǎn)地區(qū)的經(jīng)驗(yàn)進(jìn)行總結(jié)評(píng)價(jià),認(rèn)為我國(guó)的宅基地退出總體上可以分為發(fā)達(dá)地區(qū)和欠發(fā)達(dá)地區(qū)兩種模式進(jìn)行,發(fā)達(dá)地區(qū)可以通過(guò)宅基地置換的方式退出,而欠發(fā)達(dá)地區(qū)可以通過(guò)村莊整合的方式科學(xué)規(guī)劃用地。通過(guò)對(duì)宅基地動(dòng)力機(jī)制、激勵(lì)機(jī)制、流轉(zhuǎn)機(jī)制和分配機(jī)制進(jìn)行研究,本文提出了我國(guó)宅基地的退出機(jī)制。
[Abstract]:Homestead is an important part of rural land and the most important guarantee of farmers' rights and interests. Homestead is very important to the protection of peasants' right of residence, and with the advancement of urbanization, homestead is more significant to farmers. With the development of urbanization in our country, the demand for land is enlarged, and farmers can obtain the corresponding property income by withdrawing from the homestead. However, the current homestead system in our country only gives farmers the right to use, and in principle farmers should withdraw from the homestead without compensation, which greatly reduces the enthusiasm of farmers to withdraw from homestead. It can be seen that China's current homestead system has lagged far behind the economic and social development. At present, some areas in our country have made successful experience in the utilization of homestead. By learning from the experience of the pilot areas, we can perfect the homestead system in our country, and construct the withdrawal mechanism of rural homestead according to the local conditions. It can effectively integrate the rural homestead, save a lot of land resources, and provide a huge power for the urbanization of our country. Based on the summary and evaluation of the experience of the pilot areas, this paper concludes that the homestead withdrawal of our country can be divided into two modes: developed areas and underdeveloped areas, and developed areas can withdraw by means of homestead replacement. The less developed areas can plan the land scientifically by the way of village integration. Based on the study of the dynamic mechanism, incentive mechanism, circulation mechanism and distribution mechanism of homestead, this paper puts forward the exit mechanism of Homestead in China.
