我國(guó)私營(yíng)企業(yè)勞動(dòng)關(guān)系三方協(xié)商機(jī)制中的政府作用研究

【摘要】:構(gòu)建和諧勞動(dòng)關(guān)系是我國(guó)構(gòu)建和諧社會(huì)的題中之意。黨和政府始終都高度重視維護(hù)與促進(jìn)勞動(dòng)關(guān)系的穩(wěn)定和諧。我國(guó)當(dāng)前勞動(dòng)關(guān)系整體和諧,局部沖突和矛盾仍然廣泛存在,而在我國(guó)勞動(dòng)關(guān)系沖突中,私營(yíng)企業(yè)又因其起步晚、發(fā)展不完善等原因居于主要的地位,因此解決私營(yíng)企業(yè)勞動(dòng)關(guān)系不和諧因素是我國(guó)勞動(dòng)關(guān)系整體建設(shè)的首要任務(wù)。當(dāng)前三方協(xié)商機(jī)制被國(guó)際上廣泛認(rèn)為是調(diào)解勞動(dòng)關(guān)系、實(shí)現(xiàn)勞動(dòng)關(guān)系有序運(yùn)行的最有效方法,我國(guó)私營(yíng)企業(yè)三方存在有別于西方資本主義國(guó)家的特殊形態(tài),政府在完善三方協(xié)商機(jī)制建設(shè)上任重道遠(yuǎn)。 本文選擇“我國(guó)私營(yíng)企業(yè)勞動(dòng)關(guān)系三方協(xié)商機(jī)制中的政府作用”為題進(jìn)行研究,按照邏輯順序?qū)訉油七M(jìn)。本文第二章是全篇研究的理論和現(xiàn)實(shí)基礎(chǔ)。在本章中筆者首先對(duì)政府調(diào)節(jié)勞動(dòng)關(guān)系的相關(guān)理論進(jìn)行了梳理,,對(duì)政府在私營(yíng)企業(yè)勞動(dòng)關(guān)系三方協(xié)商機(jī)制中發(fā)揮作用的方式進(jìn)行了分析,分別作為全篇研究的理論基礎(chǔ)和技術(shù)線路。本章的另一個(gè)重點(diǎn)是對(duì)私營(yíng)企業(yè)勞動(dòng)關(guān)系三方協(xié)商中存在的問題的整理,該部分是本文研究的現(xiàn)實(shí)基礎(chǔ)之一;本文的第三章和第四章是全文的主體。在第三章中,筆者首先對(duì)我國(guó)政府在私營(yíng)企業(yè)勞動(dòng)關(guān)系三方協(xié)商機(jī)制中的作用的歷史變遷及其現(xiàn)狀進(jìn)行了歸納分析,而后又對(duì)我國(guó)政府在私營(yíng)企業(yè)勞動(dòng)關(guān)系三方協(xié)商機(jī)制中作用的不足進(jìn)行了總結(jié),為全篇的研究搭好了基石。本文第四章關(guān)于國(guó)外發(fā)達(dá)國(guó)家在三方協(xié)商機(jī)制中的作用借鑒對(duì)本文結(jié)論的形成具有重要的指導(dǎo)意義;本文的第五章是全文的結(jié)論部分,本章在全文研究的基礎(chǔ)上對(duì)我國(guó)政府在私營(yíng)企業(yè)勞動(dòng)關(guān)系三方協(xié)商機(jī)制中的作用目標(biāo)、作用界限進(jìn)行了界定,并提出了具體的對(duì)策和建議措施。
[Abstract]:Constructing harmonious labor relationship is the meaning of constructing harmonious society in our country. The Party and the government have always attached great importance to maintaining and promoting the stability and harmony of labor relations. At present, the labor relations in our country are harmonious, local conflicts and contradictions still exist widely. However, in the conflicts of labor relations in China, private enterprises are in the main position because of their late start and imperfect development. Therefore, solving the disharmonious factors of labor relations in private enterprises is the primary task of the overall construction of labor relations in China. At present, the tripartite consultation mechanism is widely regarded as the most effective way to mediate the labor relations and realize the orderly operation of the labor relations. There is a special form of the tripartite of the private enterprises in our country, which is different from the western capitalist countries. The government has a long way to go to improve the tripartite consultation mechanism. This paper chooses "the role of government in the tripartite consultation mechanism of labor relations of private enterprises in our country" as the topic to carry on the research, and advances in the logical order layer by layer. The second chapter is the theoretical and practical basis of the whole study. In this chapter, the author firstly combs the relevant theories of government regulation of labor relations, and analyzes the ways in which the government plays a role in the tripartite consultation mechanism of private enterprise labor relations. Respectively as the theoretical basis of the whole study and technical circuit. Another important point of this chapter is to sort out the problems existing in the tripartite negotiation of the labor relations of private enterprises, which is one of the realistic bases of this paper, and the third and fourth chapters are the main body of the thesis. In the third chapter, the author summarizes and analyzes the historical changes and the present situation of the government's role in the tripartite consultation mechanism of the private enterprise labor relations. Then it summarizes the deficiency of the government's role in the tripartite consultation mechanism of the private enterprise labor relations, which lays the foundation stone for the whole study. The fourth chapter on the role of foreign developed countries in the tripartite consultation mechanism has an important guiding significance for the formation of this conclusion, the fifth chapter is the conclusion of the full text, On the basis of the full study, this chapter defines the target and function limits of the government's role in the tripartite consultation mechanism of private enterprise labor relations, and puts forward some concrete countermeasures and suggestions.
