【摘要】：隨著近年來(lái)我國(guó)國(guó)際貿(mào)易的不斷發(fā)展,食品進(jìn)口規(guī)模不斷增加、種類不斷擴(kuò)大,因此我國(guó)的進(jìn)口食品安全監(jiān)管也面臨著一些新的形勢(shì)。一是近年來(lái)隨著科技的發(fā)展和社會(huì)的進(jìn)步,新聞媒體逐步加強(qiáng)對(duì)食品安全事件的報(bào)道宣傳,使得食品安全信息透明度空前提高,食品安全極易引起全社會(huì)的廣泛關(guān)注；二是隨著食品安全標(biāo)準(zhǔn)越來(lái)越嚴(yán)格、食品安全檢測(cè)水平的不斷提高,以及我國(guó)政府在食品安全監(jiān)管職能上的不斷完善,進(jìn)口食品安全隱患將逐漸浮現(xiàn)在公眾視野；三是因?yàn)檫M(jìn)口食品安全問(wèn)題的逐漸增加,對(duì)進(jìn)口食品安全監(jiān)管職能部門(mén)的全程監(jiān)管能力、風(fēng)險(xiǎn)預(yù)警與食品安全問(wèn)題發(fā)生時(shí)的應(yīng)急處置能力等提出了更高的要求。因此,如何有效地加強(qiáng)食品安全監(jiān)管,預(yù)防控制食品安全風(fēng)險(xiǎn)對(duì)我國(guó)經(jīng)濟(jì)社會(huì)的影響,建立健全我國(guó)進(jìn)口食品安全監(jiān)管體系,將是一項(xiàng)長(zhǎng)期、艱巨而復(fù)雜的工作。近年來(lái)我國(guó)政府高度重視食品安全監(jiān)管問(wèn)題,根據(jù)中國(guó)國(guó)情,相繼頒布了一系列旨在確保食品安全的法律法規(guī)及相關(guān)規(guī)定,健全完善了國(guó)家食品安全監(jiān)管體系,使我國(guó)食品質(zhì)量總體水平穩(wěn)步提高,但食品安全監(jiān)管是我國(guó)政府現(xiàn)在面臨的新問(wèn)題,建立健全監(jiān)管制度和長(zhǎng)效機(jī)制,加強(qiáng)食品安全監(jiān)管,對(duì)保障我國(guó)食品質(zhì)量與安全尤為重要。雖然近年來(lái)的政策調(diào)整及體系完善使得我國(guó)監(jiān)管職能部門(mén)對(duì)進(jìn)口食品的監(jiān)管雖然取得一定的進(jìn)展,但與發(fā)達(dá)國(guó)家相比,我國(guó)政府在對(duì)進(jìn)口食品的檢驗(yàn)檢測(cè)水平及全程監(jiān)管方面處于落后水平。本文第一部分對(duì)食品安全監(jiān)管相關(guān)理論進(jìn)行研究,闡述了食品安全監(jiān)管所依托的相關(guān)理論,從公共物品理論、市場(chǎng)失靈與政府干預(yù)理論以及公共治理理論分析了政府食品安全監(jiān)管職能方面的理論基礎(chǔ),并指出我國(guó)政府應(yīng)完善健全食品安全監(jiān)管的法律法規(guī)及各類檢驗(yàn)標(biāo)準(zhǔn),加強(qiáng)政府干預(yù),最大限度的避免該公共物品有害的外部影響,避免因?yàn)轶w系的漏洞所造成的食品不安全。第二部分對(duì)對(duì)我國(guó)目前進(jìn)口食品安全監(jiān)管體系的現(xiàn)狀進(jìn)行了分析,通過(guò)對(duì)我國(guó)進(jìn)口食品安全監(jiān)管體系的法律基礎(chǔ)、食品安全標(biāo)準(zhǔn)體系、監(jiān)管部門(mén)等方面的分析,總結(jié)出我國(guó)目前進(jìn)口食品安全監(jiān)管體系存在問(wèn)題。第三部分通過(guò)對(duì)美國(guó)、歐盟、日本以及加拿大食品安全監(jiān)管體系的梳理分析,得出值得我國(guó)借鑒的成熟經(jīng)驗(yàn)。最后結(jié)合我國(guó)實(shí)際國(guó)情對(duì)我國(guó)進(jìn)口食品安全監(jiān)管體系的發(fā)展完善提出了對(duì)策建議。
[Abstract]:With the development of China's international trade in recent years, the scale of food import is increasing and the kinds of food are expanding. Therefore, the supervision of import food safety in China is also facing some new situation. First, with the development of science and technology and the progress of society in recent years, the news media has gradually strengthened the reporting and propaganda of food safety incidents, which makes the transparency of food safety information unprecedented, and food safety is extremely easy to attract the attention of the whole society. Second, with the food safety standards becoming more and more strict, the level of food safety detection constantly improving, and the continuous improvement of our government in the function of food safety supervision, the hidden dangers of imported food safety will gradually emerge in the public vision; Third, because of the gradual increase of import food safety problems, higher requirements are put forward for the whole process supervision ability of the functional department of import food safety supervision, risk early warning and emergency handling ability when food safety problems occur. Therefore, how to effectively strengthen food safety supervision, prevent and control the impact of food safety risks on our economy and society, and establish and improve our import food safety supervision system will be a long-term, arduous and complex work. In recent years, the Chinese government has attached great importance to the issue of food safety supervision. In accordance with China's national conditions, it has promulgated a series of laws and regulations aimed at ensuring food safety, and has perfected the national food safety supervision system. The overall level of food quality in China has been improved steadily, but the supervision of food safety is a new problem that our government is facing now. It is very important to establish and improve the supervision system and long-term mechanism and strengthen the supervision of food safety in order to ensure the quality and safety of food in our country. Although the adjustment of policies and the improvement of the system in recent years have made certain progress in the supervision of imported food by the regulatory functional departments of our country, they are compared with those of developed countries. Our government is lagging behind in the inspection and inspection of imported food. In the first part of this paper, the related theories of food safety supervision are studied, and the related theories of food safety supervision are expounded. The theory of market failure and government intervention, as well as the theory of public governance, analyzes the theoretical basis of the function of government food safety supervision, and points out that our government should perfect the laws and regulations of food safety supervision and various inspection standards. Strengthen government intervention to minimize harmful external effects of public goods and avoid food insecurity caused by loopholes in the system. The second part has carried on the analysis to the present situation of our country's import food safety supervision system, through to our country import food safety supervision system legal foundation, the food safety standard system, the supervision department and so on aspect analysis, The existing problems of import food safety supervision system in China are summarized. In the third part, by combing and analyzing the food safety supervision system of America, European Union, Japan and Canada, we can draw the mature experience that our country can draw lessons from. Finally, countermeasures and suggestions are put forward for the development and perfection of China's import food safety supervision system in the light of the actual situation of our country.
