城市土地再開發(fā)過程中的利益沖突與規(guī)劃調(diào)控策略研究

【摘要】:現(xiàn)階段,,土地資源作為城市發(fā)展的空間基礎(chǔ)已經(jīng)趨緊,面向城市存量建設(shè)用地的土地再開發(fā)逐漸成為地方政府解決土地資源緊缺的重要途徑,但其中所引發(fā)的土地空間利益沖突問題也日益突出。城市規(guī)劃作為調(diào)控城市空間資源的重要公共政策,應(yīng)更有效地發(fā)揮平衡各方利益的職能。因此,通過揭示城市土地再發(fā)開過程中的規(guī)劃調(diào)控弱化問題及提出相應(yīng)規(guī)劃調(diào)控策略框架,為達(dá)成城市社會(huì)發(fā)展建設(shè)提供理論指導(dǎo),成為本文的關(guān)注重點(diǎn)。 本文首先對(duì)我國城市土地再開發(fā)的利益沖突現(xiàn)狀及成因進(jìn)行總結(jié)和剖析,從利益博弈的視角重新審視城市土地再開發(fā)中利益主體行為及其相互之間的沖突焦點(diǎn),為規(guī)劃調(diào)控方向提供分析的基點(diǎn)和參照系;其次,在各方?jīng)_突主體博弈互動(dòng)過程分析的基礎(chǔ)上,借助公共選擇理論分析框架對(duì)我國城市土地再開發(fā)的規(guī)劃調(diào)控現(xiàn)狀進(jìn)行歸納總結(jié),并對(duì)規(guī)劃利益調(diào)控作用失效原因進(jìn)行分析,進(jìn)而提出規(guī)劃調(diào)控的基本路徑:①經(jīng)濟(jì)層面——追求綜合效益最優(yōu);②權(quán)利結(jié)構(gòu)層面——三方權(quán)利結(jié)構(gòu)平衡;③制度層面——誘致性制度變遷;最后,在空間利益均衡目標(biāo)的作用下著重從規(guī)劃技術(shù)調(diào)配層面、規(guī)劃權(quán)利結(jié)構(gòu)重塑層面、規(guī)劃制度引導(dǎo)層面構(gòu)建規(guī)劃調(diào)控框架,并通過案例分析對(duì)相應(yīng)的規(guī)劃調(diào)控重點(diǎn)進(jìn)行反饋和優(yōu)化。 本文主要得出以下結(jié)論:第一,城市規(guī)劃是緩解當(dāng)前城市土地再開發(fā)過程中空間利益沖突的有效途徑,應(yīng)針對(duì)再開發(fā)利益博弈主體、再開發(fā)運(yùn)作機(jī)制、調(diào)控運(yùn)作重點(diǎn)等問題對(duì)現(xiàn)有規(guī)劃調(diào)控框架進(jìn)行優(yōu)化,加強(qiáng)城市規(guī)劃的公共政策職能;第二,在當(dāng)前制度環(huán)境下,城市規(guī)劃應(yīng)完善彈性技術(shù)調(diào)控手段,并側(cè)重以橫向?yàn)橹鞯膮f(xié)商過程,為相關(guān)利益主體參與城市再開發(fā)制定清晰、公開的規(guī)則,促進(jìn)空間利益的均衡分配,彌補(bǔ)城市土地再開發(fā)中的效率優(yōu)先所引起的社會(huì)公平缺失。
[Abstract]:At present, land resources, as the spatial basis of urban development, have become more and more tight. Land redevelopment for urban construction land has gradually become an important way for local governments to solve the shortage of land resources.But the conflict of interest in land space caused by it is also increasingly prominent.As an important public policy to regulate urban space resources, urban planning should play a more effective role in balancing the interests of all parties.Therefore, by revealing the weakening of planning and regulation in the process of urban land reopening and putting forward the corresponding planning and control strategy framework, it becomes the focus of this paper to provide theoretical guidance for the construction of urban social development.This paper first summarizes and analyzes the present situation and causes of interest conflict in urban land redevelopment in China, and reexamines the behavior of the main body of interest and the conflict focus between them from the perspective of interest game.It provides the basic point and reference frame for planning control direction. Secondly, on the basis of the analysis of the interactive process of the parties involved in the game,With the help of the analysis frame of public choice theory, this paper sums up the present situation of planning regulation and control of urban land redevelopment in China, and analyzes the reasons for the failure of the regulation and control function of planning interests.Furthermore, the basic path of planning and regulation is put forward, that is, the basic path of planning and regulation is: 1 economic level-seeking comprehensive benefit optimal right structure level-tripartite right structure balance and 3 institutional level-inductive institutional changes; finally,Under the function of the goal of balance of spatial interests, the planning regulatory framework is constructed from the aspects of planning technology deployment, planning right structure remolding, planning system guiding, planning regulation and control.And through the case analysis of the corresponding planning and control priorities for feedback and optimization.The main conclusions of this paper are as follows: first, urban planning is an effective way to alleviate the conflict of spatial interests in the process of urban land redevelopment.In order to strengthen the public policy function of urban planning, urban planning should improve the flexible technology regulation and control means under the current system environment.And focus on the horizontal consultation process, for the relevant stakeholders to participate in urban redevelopment to establish clear, open rules, promote the balanced distribution of space interests, make up for the urban land redevelopment efficiency priority caused by the lack of social equity.
