【摘要】：在市場(chǎng)經(jīng)濟(jì)蓬勃發(fā)展的今天，，為了營(yíng)造井然有序的市場(chǎng)環(huán)境，各個(gè)省市對(duì)商事登記制度不斷進(jìn)行改革。伴隨著廣州市商事制度改革方案的推行背景，本文試圖通過分析研究，為廣州市的商事登記制度改革提出切實(shí)可行的整改意見和更合理的商事登記制度。旨在使得商事主體在進(jìn)行商事登記時(shí)更加便捷，使得政府公共管理部門的辦事效率有所提升，切實(shí)保障每個(gè)公民的權(quán)益。本文在前人有關(guān)商事登記的基礎(chǔ)理論和研究成果的基礎(chǔ)上，對(duì)廣州市工商行政機(jī)關(guān)商事登記制度現(xiàn)狀進(jìn)行研究，并通過國(guó)內(nèi)外發(fā)達(dá)地區(qū)工商行政機(jī)關(guān)商事登記經(jīng)驗(yàn)對(duì)廣州市工商行政機(jī)關(guān)商事登記制度改革的借鑒，探索出廣州市工商行政機(jī)關(guān)商事登記對(duì)策。本文首先對(duì)現(xiàn)存的商事登記的基本理論進(jìn)行闡述，接著又對(duì)廣州市商事登記制度的改革情況作了總結(jié)，并指出了廣州市商事登記制度改革后仍存在的不完善的地方，最后提出了廣州市商事登記的發(fā)展和整改方向。得出了廣州市商事登記機(jī)關(guān)應(yīng)完善登記和審查機(jī)構(gòu)組織建設(shè)，通過建立標(biāo)準(zhǔn)的商事登記程序和強(qiáng)大的企業(yè)信息網(wǎng)絡(luò)系統(tǒng)，對(duì)商事登記實(shí)施嚴(yán)格的事后監(jiān)管，通過完善相關(guān)行政部門公共服務(wù)職能建設(shè)和系統(tǒng)對(duì)接以及簡(jiǎn)化審批和注冊(cè)手續(xù)，提高登記效率的結(jié)論。此外，商事登記的事后監(jiān)管、退出機(jī)制、中介機(jī)構(gòu)建設(shè)和代理制度的實(shí)行都應(yīng)一并提到日程上來。
[Abstract]:With the vigorous development of the market economy, in order to create an orderly market environment, every province and city continuously reforms the commercial registration system. With the implementation of the reform scheme of Guangzhou commercial system, this paper attempts to analyze and study. In order to make commercial registration more convenient for commercial subjects and improve the efficiency of government public administration department, the paper puts forward practical suggestions and more reasonable commercial registration system for the reform of commercial registration system in Guangzhou. On the basis of the previous basic theories and research results on commercial registration, this paper studies the present situation of commercial registration system of industrial and commercial administrative organs in Guangzhou. And through the experience of commercial registration of industrial and commercial administrative organs in developed regions at home and abroad, we can learn from the reform of the commercial registration system of industrial and commercial administrative organs in Guangzhou. This paper first expounds the existing basic theory of commercial registration, and then summarizes the reform of Guangzhou commercial registration system. It also points out the imperfections existing after the reform of Guangzhou commercial registration system, finally puts forward the development and rectification direction of Guangzhou commercial registration, and concludes that the Guangzhou commercial registration authority should perfect the organization and construction of the registration and examination organization. Through the establishment of standard commercial registration procedures and a strong enterprise information network system, strict ex post supervision of commercial registration is carried out, and by improving the public service function construction and system docking of relevant administrative departments and simplifying the examination and approval and registration procedures, In addition, the ex post supervision of commercial registration, exit mechanism, the construction of intermediary institutions and the implementation of agency system should be put on the agenda.
