【摘要】：氣候變暖已成為全世界面臨的最大威脅之一，而發(fā)展綠色技術(shù)能有效減少物資和能源的消耗，降低技術(shù)對(duì)環(huán)境的負(fù)面影響。綠色技術(shù)主要包括:太陽(yáng)能、生物質(zhì)能、低碳交通燃料、建筑節(jié)能以及智能電網(wǎng)技術(shù)，綠色專(zhuān)利所保護(hù)的技術(shù)方案即屬于上述綠色技術(shù)領(lǐng)域。隨著科學(xué)技術(shù)的飛速發(fā)展，政府部門(mén)在專(zhuān)利競(jìng)爭(zhēng)中扮演著越來(lái)越重要的角色，研究促進(jìn)綠色專(zhuān)利發(fā)展的政策，不僅關(guān)乎我國(guó)能源安全問(wèn)題，也關(guān)系到我國(guó)國(guó)際競(jìng)爭(zhēng)力的提高以及搶占未來(lái)發(fā)展制高點(diǎn)的重大戰(zhàn)略部署。 文章在緒論部分從選題的背景意義到國(guó)內(nèi)外研究現(xiàn)狀及研究思路、研究難點(diǎn)作了簡(jiǎn)要探討。接下來(lái)對(duì)綠色專(zhuān)利的相關(guān)概念進(jìn)行了闡述，并結(jié)合相關(guān)理論對(duì)政府政策在促進(jìn)綠色專(zhuān)利發(fā)展中的功能效用進(jìn)行了經(jīng)濟(jì)學(xué)剖析，，提出了政府在解決綠色專(zhuān)利問(wèn)題的重要性。同時(shí)根據(jù)我國(guó)綠色專(zhuān)利發(fā)展的狀況，采用SWOT分析法重點(diǎn)分析了我國(guó)綠色專(zhuān)利發(fā)展的優(yōu)勢(shì)、劣勢(shì)、機(jī)會(huì)及面臨的威脅，為我國(guó)政府制定適合國(guó)情的綠色專(zhuān)利政策提供建議。由于發(fā)達(dá)國(guó)家的綠色技術(shù)水平及綠色專(zhuān)利申請(qǐng)量均處于世界領(lǐng)先地位，第四章主要對(duì)美國(guó)、日本、英國(guó)和韓國(guó)的綠色專(zhuān)利發(fā)展現(xiàn)狀進(jìn)行分析，以期為我國(guó)政府制定促進(jìn)綠色專(zhuān)利發(fā)展的政策提供借鑒。文章最后指出，我國(guó)應(yīng)在認(rèn)清本國(guó)綠色專(zhuān)利發(fā)展的劣勢(shì)及分析外部威脅的基礎(chǔ)上，借鑒發(fā)達(dá)國(guó)家成功的經(jīng)驗(yàn)，從法律調(diào)控機(jī)制、政策協(xié)同機(jī)制及政府公共服務(wù)機(jī)制三方面來(lái)構(gòu)建促進(jìn)綠色專(zhuān)利發(fā)展的政策保障機(jī)制，以期為我國(guó)綠色專(zhuān)利的創(chuàng)造、運(yùn)用、保護(hù)和管理提供全方位的支持。
[Abstract]:Global warming has become one of the greatest threats to the world, and the development of green technology can effectively reduce the consumption of materials and energy, and reduce the negative impact of technology on the environment. Green technologies mainly include: solar energy. Biomass energy, low-carbon transportation fuel, building energy saving and smart grid technology, green patent protection of the technical scheme is belong to the above-mentioned green technology field. With the rapid development of science and technology. Government departments play a more and more important role in patent competition. The study of policies to promote the development of green patents is not only related to energy security in China. It is also related to the improvement of China's international competitiveness and the major strategic deployment of seizing the commanding heights of future development. In the introduction part, from the background significance of the topic to the domestic and foreign research status and research ideas, the research difficulties are briefly discussed. Then, the related concepts of green patent are expounded. And combined with the relevant theory of government policies in the promotion of green patent development of the functional utility of the economic analysis. This paper points out the importance of the government in solving the problem of green patent, and analyzes the advantages and disadvantages of the development of green patent in China by means of SWOT analysis method according to the situation of the development of green patent in China. The opportunities and threats provided suggestions for our government to formulate green patent policies suitable for our national conditions. Due to the level of green technology and the number of green patent applications in developed countries are in the leading position in the world. Chapter 4th mainly analyzes the current situation of green patent development in the United States, Japan, Britain and South Korea, in order to provide reference for our government to formulate policies to promote the development of green patents. On the basis of recognizing the disadvantages of green patent development and analyzing the external threats, China should draw lessons from the successful experiences of developed countries and start with the mechanism of legal regulation and control. The policy coordination mechanism and the government public service mechanism construct the policy guarantee mechanism to promote the development of the green patent, in order to provide all-round support for the creation, application, protection and management of the green patent in our country.
