【摘要】：隨著我國(guó)經(jīng)濟(jì)的持續(xù)快速發(fā)展，土地供求矛盾愈加突出，人地矛盾也更加尖銳。有限的城市土地供給總量更是使上述問(wèn)題難以解決，而地方政府為了獲得政績(jī)，加快建設(shè)，，增加財(cái)政收入，私自更改用地性質(zhì)，嚴(yán)重違背中央的宏觀調(diào)控目標(biāo)。因此中央不斷頒布土地政策，加強(qiáng)宏觀調(diào)控力度，保障民生，以達(dá)到預(yù)期的調(diào)控目標(biāo)。但由于全國(guó)范圍內(nèi)的土地監(jiān)管僅依靠中央政府，中央難以切實(shí)執(zhí)行，政策的實(shí)施效果可以說(shuō)很大程度上是取決于地方的，因?yàn)楹笳咭皇植俎k該區(qū)域的土地出讓、征收等實(shí)際工作。這使得中央政府的土地政策難以發(fā)揮保護(hù)耕地和糧食安全，維護(hù)農(nóng)民利益等作用，從而加劇了中央政府與地方政府關(guān)于土地利益的博弈。 本篇論文對(duì)中央政府與地方政府兩者對(duì)土地利益博弈的現(xiàn)狀進(jìn)行了分析，其中包括近幾年全國(guó)國(guó)土資源使用方面存在的違法用地狀況；中央與地方政府關(guān)于土地政策博弈的三個(gè)現(xiàn)實(shí)條件：中央政府與地方政府在土地目標(biāo)方面有嚴(yán)重的沖突與矛盾、中央政府與地方政府進(jìn)行的是信息不對(duì)稱博弈、地方政府擁有的財(cái)權(quán)和事權(quán)不對(duì)等；土地政策失效的四個(gè)主要原因：土地財(cái)政刺激地方財(cái)政增長(zhǎng)、土地雙軌制度、土地市場(chǎng)存在問(wèn)題以及土地政策監(jiān)督乏力。文章重點(diǎn)在于建立中央與地方政府雙贏的博弈——激勵(lì)相容機(jī)制。激勵(lì)相容機(jī)制能夠有效地解決監(jiān)管部門(mén)違規(guī)現(xiàn)象屢屢發(fā)生、員工倦怠和壟斷市場(chǎng)效率低下等問(wèn)題。構(gòu)建中央政府最優(yōu)的激勵(lì)合約，使地方政府最大限度的遵循中央政策，作出最優(yōu)行為選擇，以實(shí)現(xiàn)中央的宏觀調(diào)控目標(biāo)。 本文采取案例分析的方式，對(duì)2011年以來(lái)頒布的關(guān)于實(shí)施對(duì)違法違規(guī)用地案件進(jìn)行公開(kāi)通報(bào)政策的實(shí)施效果進(jìn)行了詳細(xì)分析。根據(jù)前文的理論分析，通過(guò)構(gòu)建委托代理模型來(lái)實(shí)現(xiàn)中央與地方政府博弈的利益分配，使其在滿足本文可能存在的創(chuàng)新點(diǎn)的同時(shí)，能夠更好地實(shí)現(xiàn)國(guó)家宏觀調(diào)控政策。
[Abstract]:With the rapid development of economy in our country , the contradiction between land supply and demand is becoming more and more acute , and the contradiction of land supply and demand is more acute . The limited urban land supply amount makes the above - mentioned problems difficult to solve . This paper analyzes the current situation of land benefit game between the central government and the local government , including the illegal land condition existing in the use of land resources in the whole country in recent years , the central and local governments have serious conflicts and contradictions in the land policy game , the central government and the local government have serious conflicts and contradictions in the land policy game , the central government and the local government have the information asymmetry game , the local government owns the problem of the land dual - track system , the land market existence question and the lack of the land policy supervision . The article focuses on the establishment of the central government ' s best incentive contract , which makes the local government adhere to the central policy to the maximum extent , and makes the optimal behavior choice to realize the central macro - control goal . This paper makes a detailed analysis of the implementation effect of the public briefing policy on the implementation of the illegal land use cases since 2011 . According to the theoretical analysis of the previous paper , the benefit distribution of the central and local government game is realized by constructing the principal agent model , so that it can better realize the national macro - control policy while meeting the innovation points which may exist in this paper .
