【摘要】:征信是保障企業(yè)乃至國家健康發(fā)展的基石,征信體系的建立可以有效減少市場交易中信用信息不對稱的情況,降低信用交易中逆向選擇和道德風(fēng)險。作為國家支柱產(chǎn)業(yè)之一的房地產(chǎn)行業(yè),位于國民經(jīng)濟(jì)鏈條的中間位置,近年來在拉動關(guān)聯(lián)產(chǎn)業(yè)、增加就業(yè)、改善居民居住環(huán)境等方面均有顯著成效。隨著房地產(chǎn)行業(yè)的快速發(fā)展,由于缺乏防范意識和有效的市場監(jiān)管而導(dǎo)致的房地產(chǎn)市場混亂,房地產(chǎn)企業(yè)失信事件頻發(fā),極大的傷害了政府、銀行和消費者的利益。在此背景下,論文提出建立房地產(chǎn)企業(yè)的征信體系,房地產(chǎn)企業(yè)征信體系的建立可以有效減少市場交易中信用信息不對稱的情況,實現(xiàn)信用信息共享,降低金融機構(gòu)的信貸風(fēng)險,保護(hù)消費者的合法權(quán)益,有助于形成健康穩(wěn)定、公平公正、誠實守信的房地產(chǎn)市場環(huán)境。 論文首先對征信和征信體系相關(guān)概念和理論進(jìn)行了闡述,接著對房地產(chǎn)企業(yè)建設(shè)征信體系的必要性和可行性進(jìn)行了分析,指出房地產(chǎn)企業(yè)征信體系的建設(shè)可以有效降低信貸風(fēng)險,維持房地產(chǎn)市場的穩(wěn)定,并分析了當(dāng)前建立房地產(chǎn)企業(yè)征信體系已具備的條件;其次,對比分析了美國、歐洲和日本三種不同的企業(yè)征信制度,提出當(dāng)前我國房地產(chǎn)企業(yè)征信體系的建設(shè)應(yīng)當(dāng)采用公共征信和私營征信并存的模式,在建設(shè)初期,,以公共征信為主,政府兼有經(jīng)營者和管理者雙重身份,利用信息優(yōu)勢全面征集房地產(chǎn)企業(yè)的信用信息,并大力推進(jìn)第三方征信機構(gòu)的發(fā)展,隨著征信市場發(fā)展的逐漸成熟,政府便逐漸淡化經(jīng)營者的身份轉(zhuǎn)向監(jiān)督者的身份,以市場化的私營征信為主;最后論文嘗試構(gòu)建了我國房地產(chǎn)企業(yè)征信體系,包括征信數(shù)據(jù)庫的建立、信用評價機制的構(gòu)建、失信懲戒機制的構(gòu)建、信用風(fēng)險轉(zhuǎn)化機制的構(gòu)建、征信管理機制的構(gòu)建和宣傳教育機制的構(gòu)建共六方面的內(nèi)容,并選取了重慶市房地產(chǎn)企業(yè)征信體系的案例進(jìn)行了實證研究,提出了構(gòu)建我國房地產(chǎn)企業(yè)征信體系的現(xiàn)實路徑。
[Abstract]:Credit information is the cornerstone of the healthy development of the enterprises and even the state . The establishment of the credit system can effectively reduce the asymmetry of credit information in the market transaction , reduce the adverse selection and moral hazard in the credit transaction . As the real estate industry of one of the pillar industries of the country , the real estate market is in disorder due to the lack of prevention awareness and effective market supervision . In this context , the establishment of the real estate enterprise credit system can effectively reduce the credit information asymmetry in the market transaction , realize the credit information sharing , reduce the credit risk of the financial institution , protect the legitimate rights and interests of the consumers , and help to form a healthy and stable , fair and honest real estate market environment .
