【摘要】:民以食為天,食以安為先。食品是人類賴以生存和發(fā)展的重要物質(zhì)基礎(chǔ),而食品安全事件頻頻發(fā)生,是近年來的社會熱點問題之一,2008年9月份爆出的“三鹿毒奶粉”事件震驚世界,同時也再次引起全國上下的極大關(guān)注。面對全球及我國接連不斷發(fā)生的惡性食品安全事故,,社會各方面對于對食品安全重視程度空前高漲。進(jìn)一步加強和完善食品安全監(jiān)管機制建設(shè)已成為理論界關(guān)注的焦點和迫切的現(xiàn)實需要。 論文采用文獻(xiàn)研究法,廣泛收集當(dāng)前我國對于食品安全及監(jiān)管的最新研究成果,通過資料分析對國內(nèi)外食品安全監(jiān)管現(xiàn)狀進(jìn)行了總結(jié)。并探討了我國食品安全監(jiān)管的歷史過程,分析了當(dāng)前我國食品安全及監(jiān)管方面存在的主要問題是多部門分段監(jiān)管與政府失靈和法律法規(guī)及標(biāo)準(zhǔn)體系不健全。積極吸納發(fā)達(dá)國家食品安全監(jiān)管方面的模式及主要做法,立足唐山市路南區(qū)經(jīng)濟(jì)發(fā)展現(xiàn)狀,采用實際調(diào)研的方法,對路南區(qū)食品安全及食品安全監(jiān)管現(xiàn)狀進(jìn)行了調(diào)研,對存在問題進(jìn)行了歸納分析,并分析了問題產(chǎn)生的主要原因,提出了路南區(qū)食品監(jiān)管的對策措施:一是整合與轉(zhuǎn)移食品安全監(jiān)管中執(zhí)法權(quán),成立負(fù)責(zé)全區(qū)食品安全委員會,徹底解決基層行政執(zhí)法中存在的重復(fù)執(zhí)法、多頭執(zhí)法、權(quán)責(zé)分割等問題;二是構(gòu)建前饋式管理理念;三是完善協(xié)調(diào)一致的監(jiān)管體制;四是推廣HACCP體系認(rèn)證;五是加強以道德建設(shè)為核心的信用體系建設(shè);六是充分發(fā)揮檢察機關(guān)的法律監(jiān)督職能。
[Abstract]:Food is an important material foundation for human survival and development, and food safety incidents occur frequently, which is one of the hot social issues in recent years. In September 2008, the "Sanlu Milk Powder" incident shocked the world, but also caused great concern from all over the country again. In the face of the world and China, a series of malignant food safety accidents occurred one after another. All aspects of society pay more attention to food safety than ever before, and further strengthen and perfect the construction of food safety supervision mechanism has become the focus of attention and urgent practical needs of the theoretical circle. This paper adopts the method of literature research to collect the latest research results of food safety and supervision in China. The current situation of food safety supervision at home and abroad was summarized through data analysis, and the historical process of food safety supervision in China was discussed. The main problems in food safety and supervision in China are analyzed. The main problems are multi-sector supervision and government failure, imperfect laws, regulations and standards, and the mode of actively absorbing food safety supervision in developed countries. Main practice. Based on the present situation of economic development in LuSouthern District of Tangshan City, the present situation of food safety and food safety supervision was investigated by using the method of actual investigation, and the existing problems were summarized and analyzed. The main reasons of the problem are analyzed and the countermeasures of food supervision in Lunan District are put forward. Firstly, the law enforcement power in food safety supervision should be integrated and transferred, and the food safety committee in charge of the whole region should be set up. To solve the problems of repeated law enforcement, multiple law enforcement and separation of powers and responsibilities in administrative law enforcement at the grass-roots level; The second is to construct the concept of feedforward management; Third, perfect the coordinated supervision system; Fourth, promote HACCP system certification; Fifth, strengthen the construction of credit system with moral construction as the core; Sixth, give full play to the legal supervision function of procuratorial organs.
