【摘要】：新型城鎮(zhèn)化是新一屆中央領(lǐng)導(dǎo)集體的重大戰(zhàn)略選擇,對實(shí)現(xiàn)社會主義現(xiàn)代化具有戰(zhàn)略意義。推進(jìn)新型城鎮(zhèn)化,必須深入推進(jìn)土地制度改革,而農(nóng)村宅基地流轉(zhuǎn)問題是土地制度改革的重要組織部分。建國以來,我國農(nóng)民宅基地經(jīng)歷了從農(nóng)民所有到集體所有的變遷,當(dāng)前農(nóng)村宅基地所有權(quán)歸農(nóng)村集體經(jīng)濟(jì)組織,農(nóng)戶僅具有農(nóng)村宅基地使用權(quán),并且農(nóng)村宅基地不能自由流轉(zhuǎn)。農(nóng)村宅基地限制流轉(zhuǎn)的規(guī)定,帶來農(nóng)戶宅基地及其上住房價(jià)值難以體現(xiàn)、農(nóng)村土地資源浪費(fèi)、隱形交易難以規(guī)范等困境。而造成這些困境深層原因,包括土地制度改革的保守性、利益主體的阻礙、舊制度的慣性等。針對反對農(nóng)村宅基地流轉(zhuǎn)的觀點(diǎn),本文圍繞農(nóng)村宅基地的社會保障功能、宅基地流轉(zhuǎn)有利于強(qiáng)勢群體、宅基地流轉(zhuǎn)破壞農(nóng)村功能和倫理等觀點(diǎn)逐一進(jìn)行反駁,并從宅基地流轉(zhuǎn)的客觀需求與風(fēng)險(xiǎn)防范等角度論證宅基地流轉(zhuǎn)的合理性。本文認(rèn)為,農(nóng)村宅基地流轉(zhuǎn)應(yīng)堅(jiān)持整體漸進(jìn)、自愿有償、利益協(xié)調(diào)原則,并通過確定恰當(dāng)模式、設(shè)置前置條件、完善配套措施等路徑來保障流轉(zhuǎn)的規(guī)范有序進(jìn)行。在本文最后,筆者還從修改現(xiàn)行法律、制定相關(guān)條例、出臺專門規(guī)章三個(gè)維度提出農(nóng)村宅基地流轉(zhuǎn)的立法保障思路。
[Abstract]:The new urbanization is a major strategic choice for the new central leadership, which is of strategic significance to the realization of socialist modernization. To promote the new urbanization, the reform of the land system must be further promoted, and the issue of rural homestead circulation is an important part of the reform of the land system. Since the founding of the people's Republic of China, farmers' homestead has experienced changes from farmers' ownership to collective ownership. The ownership of rural homestead belongs to the rural collective economic organization. Farmers only have the right to use the rural homestead, and the rural homestead cannot be freely transferred. The restrictions on the transfer of rural homestead will bring difficulties to farmers' housing land and housing value, wasting rural land resources and difficult to regulate invisible transactions. The deep reasons for these difficulties are the conservatism of the reform of the land system, the hindrance of the interests of the interests, the inertia of the old system and so on. Against the rural land circulation, this paper focuses on the social security function of rural homestead, homestead circulation in favor of a strong group, destruction of rural homestead circulation function and ethical point of view one by one to refute, reasonable demands and risks and prevent the homestead transfer from the angles of land circulation. This paper believes that the transfer of rural homestead should adhere to the principle of overall, progressive, voluntary, and interest coordination, and ensure the orderly and orderly transfer by determining the appropriate mode, setting the precondition and improving the supporting measures. At the end of the paper, the author also puts forward the legislative guarantee for the transfer of rural homestead from the following three dimensions: Amending the existing laws, formulating relevant regulations and issuing special rules.
