FRAND準(zhǔn)則視角下標(biāo)準(zhǔn)必要專利的許可定價(jià)方法研究

【摘要】：伴隨著經(jīng)濟(jì)全球化的深入發(fā)展以及技術(shù)創(chuàng)新速度的加快,專利技術(shù)與標(biāo)準(zhǔn)日益融合,圍繞標(biāo)準(zhǔn)必要專利的爭(zhēng)端和訴訟也日益增多,而這些爭(zhēng)端和訴訟的核心問題均直指標(biāo)準(zhǔn)必要專利及其合理的許可價(jià)格。作為一個(gè)新興領(lǐng)域,很多重要問題有待系統(tǒng)深入研究,討論FRAND準(zhǔn)則視角下標(biāo)準(zhǔn)必要專利的許可定價(jià)方法有利于知識(shí)產(chǎn)權(quán)爭(zhēng)端的解決,科學(xué)應(yīng)對(duì)知識(shí)產(chǎn)權(quán)許可制度帶來的挑戰(zhàn),有助于我國(guó)創(chuàng)新驅(qū)動(dòng)發(fā)展戰(zhàn)略的實(shí)施。論文以專利價(jià)值評(píng)估理論和利益均衡理論為指導(dǎo),利用文獻(xiàn)研究、專利情報(bào)檢索與分析、多案例研究、經(jīng)濟(jì)學(xué)模型等方法對(duì)FRAND準(zhǔn)則視角下標(biāo)準(zhǔn)必要專利的許可定價(jià)問題進(jìn)行了系統(tǒng)研究。首先,對(duì)標(biāo)準(zhǔn)必要專利FRAND許可定價(jià)的相關(guān)理論進(jìn)行了闡述,然后梳理了標(biāo)準(zhǔn)必要專利的形成過程,并利用專利情報(bào)檢索對(duì)涉案標(biāo)準(zhǔn)必要專利的統(tǒng)計(jì)特征進(jìn)行了分析;第三,根據(jù)利益均衡理論構(gòu)建了標(biāo)準(zhǔn)必要專利FRAND許可的具體原則;第四,根據(jù)法庭實(shí)踐中的9個(gè)案例進(jìn)行多案例研究,提取影響許可定價(jià)的關(guān)鍵因素以及許可定價(jià)路徑;第五,擴(kuò)展了Swanson-Baumol模型,并應(yīng)用到三個(gè)組件下標(biāo)準(zhǔn)必要專利的許可定價(jià);最后,根據(jù)研究發(fā)現(xiàn),從政府、法院、標(biāo)準(zhǔn)制定組織、企業(yè)等不同層面分別提出標(biāo)準(zhǔn)必要專利在FRAND準(zhǔn)則下進(jìn)行許可定價(jià)的對(duì)策建議。論文研究的主要貢獻(xiàn)有:(1)對(duì)標(biāo)準(zhǔn)必要專利的統(tǒng)計(jì)特征進(jìn)行了識(shí)別;(2)明確了在FRAND準(zhǔn)則下進(jìn)行標(biāo)準(zhǔn)必要專利的許可應(yīng)該基于利益均衡理論滿足的3個(gè)具體的原則;(3)識(shí)別了標(biāo)準(zhǔn)必要專利許可的主要影響因素和定價(jià)路徑、方法,提出了標(biāo)準(zhǔn)必要專利FRAND許可的3條路徑;(4)分別針對(duì)政府、標(biāo)準(zhǔn)制定組織、法院、企業(yè)等不同主體提出實(shí)踐層面的建議。
[Abstract]:With the further development of economic globalization and the acceleration of technological innovation, patent technology and standards are increasingly integrated, and disputes and litigation around the necessary patents of standards are increasing day by day. The core issues of these disputes and lawsuits are the standard necessary patents and their reasonable licensing prices. As a new field, many important issues need to be studied systematically. It is beneficial to solve intellectual property disputes by discussing the licensing pricing method of standard necessary patents from the perspective of FRAND, and to meet the challenge of intellectual property licensing system scientifically. It is helpful for the implementation of innovation-driven development strategy in China. Guided by the theory of patent value evaluation and the theory of balance of interests, the thesis uses literature research, patent information retrieval and analysis, and multi-case studies. This paper systematically studies the licensing pricing of standard essential patents from the perspective of FRAND criterion by means of economic models. First of all, the relevant theory of standard essential patent FRAND license pricing is expounded, then the formation process of standard essential patent is combed out, and the statistical characteristics of standard essential patent are analyzed by patent information retrieval. According to the theory of equilibrium of interests, this paper constructs the specific principles of standard essential patent FRAND license. Fourthly, according to 9 cases in court practice, it carries out multi-case studies to extract the key factors that affect licensing pricing and the path of licensing pricing. Extended the Swanson-Baumol model and applied to the licensing pricing of standard essential patents under three components; finally, according to the study, from the government, courts, standard-setting organizations, Enterprises and other different levels respectively put forward the standard necessary patents under the FRAND guidelines for licensing pricing countermeasures. The main contributions of this paper are as follows: (1) the statistical characteristics of standard essential patents are identified; (2) the three specific principles that the licensing of standard essential patents under the FRAND criterion should be satisfied based on the theory of equilibrium of interests; (3) the recognition of the three specific principles which should be satisfied by the theory of equilibrium of interests; The main influencing factors and pricing path of the standard necessary patent license, Methods: three paths of FRAND license for standard necessary patent are put forward. (4) suggestions on practice are put forward for different subjects such as government, standard-setting organization, court, enterprise and so on.
