【摘要】：當(dāng)前,我國(guó)建設(shè)工程領(lǐng)域已經(jīng)全面進(jìn)入了工程量清單計(jì)價(jià)時(shí)代,但是從招標(biāo)的效果來(lái)看,工程量清單計(jì)價(jià)辦法的實(shí)施仍沒(méi)有達(dá)到更有利于市場(chǎng)競(jìng)爭(zhēng)、降低造價(jià)的目的,而且又暴露了許多新問(wèn)題,政府招投標(biāo)監(jiān)管部門(mén)的治理效果也不理想,該領(lǐng)域始終呈現(xiàn)“道高一尺,魔高一丈”現(xiàn)象。所以當(dāng)前制定更科學(xué)的評(píng)標(biāo)方法顯得更有現(xiàn)實(shí)意義,以及如何營(yíng)造公平、誠(chéng)信、健康的招投標(biāo)環(huán)境也是政府有關(guān)部門(mén)當(dāng)前急需解決的問(wèn)題。本文通過(guò)查閱近年來(lái)的相關(guān)文獻(xiàn)資料,對(duì)我國(guó)目前招標(biāo)領(lǐng)域出現(xiàn)的諸如招標(biāo)人、投標(biāo)人、政府監(jiān)管、評(píng)標(biāo)辦法等方面的問(wèn)題進(jìn)行梳理歸納。針對(duì)某省房屋建筑工程招投標(biāo)領(lǐng)域?qū)嵭泄こ塘壳鍐斡?jì)價(jià)后的中標(biāo)情況進(jìn)行統(tǒng)計(jì),并對(duì)相關(guān)數(shù)據(jù)進(jìn)行整理,在此基礎(chǔ)上引入中標(biāo)價(jià)限價(jià)偏差率的概念,用直方圖法將中標(biāo)價(jià)限價(jià)偏差率按照中標(biāo)項(xiàng)目數(shù)進(jìn)行統(tǒng)計(jì)分析,中標(biāo)價(jià)限價(jià)偏差率分布呈現(xiàn)嚴(yán)重的正偏態(tài),而且不同投資規(guī)模下的中標(biāo)價(jià)限價(jià)偏差率呈現(xiàn)相似的分布,從統(tǒng)計(jì)數(shù)據(jù)可以分析出90%以上項(xiàng)目的中標(biāo)價(jià)限價(jià)偏差率在3%以內(nèi)。這種中標(biāo)價(jià)限價(jià)偏差率小的結(jié)論與正常的正態(tài)分布相悖,所以當(dāng)前市場(chǎng)狀況明顯不符合常規(guī)。分析產(chǎn)生該現(xiàn)象的原因:一方面是工程量清單計(jì)價(jià)下的綜合評(píng)標(biāo)法存在嚴(yán)重缺陷,投標(biāo)總報(bào)價(jià)未作為評(píng)標(biāo)指標(biāo);另一方面是招標(biāo)市場(chǎng)可能存在較嚴(yán)重的圍標(biāo)、串標(biāo)及大幅度壓低招標(biāo)控制價(jià)等違法、違規(guī)行為。這種現(xiàn)象不僅會(huì)導(dǎo)致招標(biāo)人遭受嚴(yán)重經(jīng)濟(jì)損失,還會(huì)嚴(yán)重地侵害相關(guān)市場(chǎng)主體的合法利益,破壞招投標(biāo)領(lǐng)域中公平自由的競(jìng)爭(zhēng)秩序,妨礙招投標(biāo)競(jìng)爭(zhēng)機(jī)制功能的發(fā)揮。對(duì)于當(dāng)前招投標(biāo)領(lǐng)域存在的諸多問(wèn)題,如若得以有效解決,需進(jìn)一步完善招投標(biāo)中的評(píng)標(biāo)體系建設(shè),評(píng)標(biāo)體系構(gòu)建應(yīng)能覆蓋影響評(píng)標(biāo)結(jié)果的主要環(huán)節(jié),論文提出了一種新型評(píng)標(biāo)體系,包含建設(shè)工程評(píng)標(biāo)辦法體系、建設(shè)工程信息平臺(tái)體系、建設(shè)工程誠(chéng)信評(píng)價(jià)體系、建設(shè)工程評(píng)標(biāo)保障體系四個(gè)方面,并進(jìn)一步對(duì)各體系的內(nèi)容進(jìn)行分析與構(gòu)建,從而為解決當(dāng)前招投標(biāo)過(guò)程中存在的問(wèn)題,提供解決思路。
[Abstract]:At present, the field of construction engineering in our country has entered an era of bill of quantities valuation in an all-round way. However, from the effect of bidding, the implementation of valuation method of bill of quantities has not reached the goal of more favorable to market competition and lower cost.But also exposed many new problems, the government bidding supervision department's governance effect is also not ideal, this field always presents "the road is one foot, the evil is high" the phenomenon.Therefore, it is of more practical significance to establish a more scientific bid evaluation method, and how to create a fair, honest and healthy bidding environment is also a problem that government departments urgently need to solve.By referring to the relevant literature in recent years, this paper summarizes the problems in the field of bidding in China, such as tenderer, bidder, government supervision, bid evaluation method and so on.According to the statistics of the winning bid in the bidding field of a certain province, the paper introduces the concept of the deviation rate of the middle price limit price, which is based on the statistical analysis of the relevant data.According to the number of winning bid items, the deviation rate of the price limit is statistically analyzed by histogram method. The distribution of the deviation rate of the price limit in the bid price shows a serious positive deviation, and the deviation rate of the price limit under different investment scale shows a similar distribution.From the statistical data, we can find out that the deviation rate of the middle price limit price of more than 90% items is less than 3%.This conclusion is contrary to the normal distribution, so the current market situation is obviously out of order.The causes of this phenomenon are analyzed: on the one hand, there are serious defects in the comprehensive bid evaluation method under the valuation of bill of quantities, and the total bid quotation is not regarded as the evaluation index; on the other hand, there may be serious surrounding bids in the bidding market.String bid and greatly reduce the bid control price and other illegal, illegal behavior.This phenomenon will not only cause the tenderer to suffer serious economic losses, but also will seriously infringe on the legitimate interests of the relevant market subjects, destroy the fair and free competition order in the bidding field, and hinder the function of the bidding competition mechanism.If the problems in the current bidding field are solved effectively, it is necessary to further improve the construction of bid evaluation system in bidding. The construction of bid evaluation system should cover the main links that affect the result of bid evaluation.This paper puts forward a new bidding evaluation system, which includes four aspects: construction engineering bid evaluation method system, construction engineering information platform system, construction project integrity evaluation system, construction engineering bid evaluation guarantee system.Furthermore, the contents of each system are analyzed and constructed so as to solve the problems existing in the process of bidding and offer solutions.
