【摘要】：近年來隨著城市經濟建設的快速發(fā)展和城鎮(zhèn)化進程的不斷推進,城市公共設施的建設與居民安居樂業(yè)的幸福需求交錯在一起,造成了鄰避沖突發(fā)生頻率逐年上升,其中公共設施的建設與居民的生活健康矛盾,已成為當今鄰避沖突發(fā)生的主要類型。據統(tǒng)計,中國近十年來鄰避沖突事件數量和參與人數均呈上升趨勢,參與人員達到了成百上千,甚至上萬人參與的事件在全國也屢見不鮮,而且鄰避沖突事件涉及的行業(yè)也越來越多,主體成分也漸趨多元化。雖然公共設施建設對整個社會和當地的經濟建設起到不可估量的作用,但是給附近的居民也帶來了相應的負面影響,當這種負面影響達到一定程度的時候,便會引起沖突。如何權衡利弊,如何應對已出現公共設施建設中的鄰避沖突問題,如何有效的抑制鄰避沖突發(fā)生,這些都值得社會和當地有關政府部門的深思。研究公共設施建設中發(fā)生的鄰避沖突問題,可以為我國公共設施建設中鄰避沖突問題的解決提供借鑒。從國內外的研究文獻中不難看出,我國的鄰避沖突研究理論較為豐富,但是缺乏實際成功治理的案例且部分地區(qū)較為成功的實踐經驗沒有得到廣泛的推廣和應用。因此本文希望通過研究鄰避沖突問題并分析其產生的原因,可以找出如何有效解決問題的具體措施,為政府應對這類沖突事件提供對策建議。本文重點闡述了公共設施建設中鄰避沖突的定義以及目前我國在公共設施建設中鄰避沖突的問題和成因,并通過朔州市垃圾場建設案例分析了鄰避沖突事件起因、發(fā)展、爆發(fā)、解決四個過程,為研究化解鄰避沖突問題提供了事實依據。最后本文從構建多元糾紛解決機制、重塑傳統(tǒng)價值取向,提高政府的執(zhí)行能力、建立信息暢通治理機制等方面入手提出切實可行的解決措施。在現代社會中,鄰避沖突已經成為阻礙公共設施建設的主要因素,有效的解決這一沖突,有助于社會的穩(wěn)定與和諧發(fā)展。
[Abstract]:In recent years, with the rapid development of urban economic construction and the continuous advancement of urbanization, the construction of urban public facilities and the happy needs of residents living and working in peace and contentment intertwined, resulting in a rising frequency of conflict avoidance. Among them, the contradiction between the construction of public facilities and the living health of residents has become the main type of conflict avoidance. According to statistics, the number of conflict avoidance incidents and the number of participants in the past ten years in China are on the rise. The number of incidents involving hundreds, even tens of thousands of people has been common throughout the country, and more and more industries have been involved in neighboring incidents of conflict avoidance. Although the construction of public facilities has played an inestimable role in the whole society and the local economic construction, it has also brought about a corresponding negative impact on the nearby residents. When this negative impact reaches a certain level, it will lead to conflict. How to weigh the pros and cons, how to deal with the problem of conflict avoidance in the construction of public facilities, how to effectively restrain the conflict avoidance, All these are worth thinking deeply about by the society and relevant local government departments. We should study the problem of conflict avoidance in the construction of public facilities. It can be used as a reference for solving the problem of conflict avoidance in the construction of public facilities in China, and it is not difficult to see from the domestic and foreign research literature that the theory of conflict avoidance in our country is relatively rich. However, the case of lack of practical successful governance and some successful practical experience in some areas have not been widely promoted and applied. Therefore, this paper hopes to study the problem of conflict avoidance and analyze the causes of its occurrence. You can find out how to solve the problem effectively, This paper focuses on the definition of conflict avoidance in the construction of public facilities and the problems and causes of conflict avoidance in the construction of public facilities in China. And through the construction case of Shuozhou garbage dump, this paper analyzes the cause, development, outbreak and settlement of the conflict avoidance event, which provides a factual basis for the study of the conflict avoidance problem. Finally, this paper constructs a multi-party dispute resolution mechanism. Remolding the traditional value orientation, improving the executive ability of the government, establishing the mechanism of information unimpeded governance and so on, put forward the feasible solution. In the modern society, the neighbor avoiding the conflict has become the main factor that hinders the construction of the public facilities. An effective solution to this conflict is conducive to social stability and harmonious development.
