【摘要】：以集體建設(shè)用地為核心的存量改造在廣東推行已逾七年。檢討相關(guān)政策實(shí)施的文獻(xiàn),發(fā)現(xiàn)利益各方圍繞土地增值收益的博弈是推動(dòng)改造和塑造結(jié)果的關(guān)鍵。同時(shí),規(guī)劃調(diào)控弱、開(kāi)發(fā)強(qiáng)度過(guò)高和公益設(shè)施配套不足極為普遍。然而,從微觀層面對(duì)改造失控背后制度性邏輯的研究匱乏。此外,已有研究多視開(kāi)發(fā)商逐利、政府尋租以及兩者的合謀為改造失控的主因,而對(duì)土地持有者如農(nóng)村集體的角色鮮有涉及。本文結(jié)合制度變遷的理論和村莊改造案例的深度實(shí)證探討制度轉(zhuǎn)型、利益各方權(quán)利關(guān)系演化和博弈的結(jié)果。研究發(fā)現(xiàn)舊改政策強(qiáng)化了村集體的地權(quán),但對(duì)土地增值收益的再分配未充分界定。在不確定的制度環(huán)境下,積極推動(dòng)改造的政府先期投入以保障集體收益,而村集體則依托現(xiàn)實(shí)的土地占有占據(jù)博弈的主動(dòng),不斷"把持"政府,爭(zhēng)奪土地收益,最終使政府在維持社會(huì)公益上逐步妥協(xié),危及空間品質(zhì)和社會(huì)公平,與包容性發(fā)展?jié)u行漸遠(yuǎn)。舊改應(yīng)力求政府統(tǒng)籌,完善利益分配和規(guī)劃制度。
[Abstract]:Collective construction land as the core of the stock transformation in Guangdong has been implemented for more than seven years. Reviewing the relevant policy implementation literature, it is found that the game around the land value-added income is the key to promote the transformation and shape the results. At the same time, the planning control is weak, the development intensity is too high and the public welfare facilities are insufficient. However, the study of institutional logic behind the transformation from the micro level is scarce. In addition, there are many studies on developers seeking profits, government rent-seeking and the collusion of the two as the main reason for the transformation out of control, but the role of landholders such as rural collectives is rarely involved. Based on the theory of institutional change and the case of village reconstruction, this paper discusses the institutional transformation, the evolution of the rights relationship between the parties concerned and the result of the game. The study found that the old reform policy strengthened the land ownership of the village collective, but the redistribution of the land value-added income was not fully defined. In the uncertain system environment, the government actively promotes the transformation of the government to protect the collective income, while the village collective relies on the active of the real land occupation game, and constantly "controls" the government to compete for land income. Finally, the government compromises gradually on the maintenance of social welfare, endangers the space quality and social equity, and is far away from inclusive development. The old reform should strive for the government as a whole and perfect the benefit distribution and planning system.
