【摘要】：改革開放以來,我國建設工程招標投標事業(yè)發(fā)展迅速,招標領域不斷擴大,法規(guī)體系日益完善,行政監(jiān)督逐步加強,招標投標已經(jīng)成為建設工程項目發(fā)承包的主要方式。但是,我們看到在工程建設領域,尤其在工程招標投標市場上,圍標串標、業(yè)績造假、惡意投訴等違規(guī)現(xiàn)象屢見不鮮,嚴重擾亂了正常的市場交易秩序,侵害了招投標雙方的合法權(quán)益,造成國家和公眾利益的損失。 在國家大力倡導信息化建設的背景下,電子招標投標的應用與發(fā)展,為建設行業(yè)主管部門強化建設市場監(jiān)管,懲治招標投標活動中的違法違規(guī)行為提供了現(xiàn)代化的手段,是提高招投標效率、降低交易成本、治理工程建設領域突出問題的重要舉措,也是落實中央懲治和預防腐敗長效機制建設的一項重要任務。 本文從招標投標監(jiān)督管理和行業(yè)發(fā)展的角度,以建設工程電子招標投標系統(tǒng)及應用為研究對象,研究了電子招標投標系統(tǒng)在建設和應用過程中遇到的瓶頸性問題,結(jié)合作者自身參與電子招標投標系統(tǒng)建設和赴各地調(diào)研的經(jīng)歷,提出了相應的解決措施。主要研究內(nèi)容包括： 首先,介紹了研究背景、發(fā)展現(xiàn)狀及面臨的問題；其次,介紹了電子招標投標的研究現(xiàn)狀和國內(nèi)外經(jīng)驗,以及從經(jīng)驗中得到的啟示；再次,在電子招標投標系統(tǒng)建設層面上,研究分析了電子招標投標系統(tǒng)的設計原則、技術(shù)構(gòu)架、實踐模式以及系統(tǒng)構(gòu)成等內(nèi)容；然后,針對電子招標投標系統(tǒng)應用問題進行專題研究,提出對策措施,并在招標投標電子化對市場各方主體的影響、政府在招標投標電子化過程中的作用、招標投標全過程電子監(jiān)管體系的構(gòu)建三方面進行了重點分析和闡述；最后,對杭州市建設工程電子招標投標系統(tǒng)進行實例研究,分析其系統(tǒng)構(gòu)成、運行流程、監(jiān)管體系、做法和成效。
[Abstract]:Since the reform and opening up, bidding for construction projects in China has developed rapidly, the bidding field has been continuously expanded, the legal system has been increasingly improved, and administrative supervision has been gradually strengthened. Bidding and bidding has become the main way to contract construction projects. We see that in the field of engineering construction, especially in the bidding and bidding market for projects, irregularities such as surrounding bid strings, false performance, malicious complaints and so on are common, seriously disrupting the normal order of market transactions. It infringes the legitimate rights and interests of both bidding parties and results in the loss of national and public interests. The application and development of electronic bidding has provided modern means for the construction industry to strengthen the supervision of the construction market and punish the illegal and illegal activities in the bidding activities. It is an important measure to improve the efficiency of bidding, reduce the transaction cost and solve the outstanding problems in the field of engineering construction. It is also an important task for the implementation of the long-term mechanism construction of the central government to punish and prevent corruption. From the point of view of the supervision and management of bidding and the development of the industry, this paper studies the bottleneck problems encountered in the construction and application of the electronic bidding and bidding system in the construction and application of the electronic bidding system. Based on the author's experience of participating in the construction of electronic bidding and bidding system and conducting research in various places, the author puts forward corresponding solutions. The main research contents are as follows:. First, introduced the research background, the development present situation and the question which faces; secondly, introduced the electronic bidding research present situation and the domestic and foreign experience, as well as from the experience obtains enlightenment; again, in the electronic bidding and bidding system construction level, This paper studies and analyzes the design principles, technical framework, practice model and system composition of the electronic bidding and bidding system, and then makes a special study on the application of the electronic tendering and bidding system, and puts forward some countermeasures. And in the electronic bidding on the main market parties, the role of the government in the process of electronic tendering and bidding, the construction of the whole process of electronic supervision system has been analyzed and elaborated. This paper makes an example study on the electronic bidding system of Hangzhou construction project, and analyzes its system composition, operation flow, supervision system, practice and effect.
