【摘要】：開放發(fā)展是五大新發(fā)展理念之一,具體落實(shí)到"引進(jìn)來"與"走出去"兩個(gè)層面的法律機(jī)制。通過制度比較,我國(guó)金融中心城市建設(shè)大致以開放發(fā)展金融政策為先導(dǎo),以地方金融立法進(jìn)行特色促進(jìn),加以國(guó)家性金融立法的普遍適用。上海立足建設(shè)國(guó)際大都市,必須秉承開放發(fā)展理念,引導(dǎo)開放發(fā)展的機(jī)制設(shè)計(jì)。"引進(jìn)來"要從金融市場(chǎng)、金融機(jī)構(gòu)、金融產(chǎn)品、金融人才、金融監(jiān)管五個(gè)層面展開,"走出去"要加強(qiáng)與我國(guó)港澳臺(tái)地區(qū)、其他國(guó)家金融中心城市、國(guó)際金融組織等層面的金融合作。未來的《金融中心城市促進(jìn)法》要明確"開放發(fā)展"的立法宗旨,納入開放發(fā)展的特色機(jī)制,實(shí)現(xiàn)從上海特色到全國(guó)統(tǒng)一立法的"自下而上"制度變遷。
[Abstract]:Open development is one of the five new development ideas, which is implemented into the legal mechanism of "introducing in" and "going out". Through the system comparison, the financial policy of open development is the forerunner of the construction of the financial center city in our country, and the local financial legislation is promoted with the characteristics of the local financial legislation, and the national financial legislation is generally applicable. Based on the construction of an international metropolis, Shanghai must adhere to the concept of open development and guide the mechanism design of open development. "introduction" should be carried out from five levels: financial market, financial institutions, financial products, financial talents and financial supervision, and "going out" should strengthen financial cooperation with Hong Kong, Macao and Taiwan, other countries, financial center cities, international financial organizations and so on. The future Law on the Promotion of Financial Center cities should clarify the legislative purpose of "open development", incorporate the characteristic mechanism of open development, and realize the "bottom-up" institutional change from Shanghai characteristics to national unified legislation.
