【摘要】：我國自由貿易試驗區(qū)在外商投資制度改革方面,確立了以準入前國民待遇和負面清單管理模式的外商投資準入制度、以政府行政審批"一站式"服務為特點的商事登記備案制度、以取消事前審批加強事中事后監(jiān)督為核心的監(jiān)管制度。自由貿易試驗區(qū)外商投資制度與國際經(jīng)濟貿易投資規(guī)則深度接軌,對未來我國其他自由貿易區(qū)外商投資制度的建立及實施起到了良好的示范作用。但是,目前自由貿易試驗區(qū)外商投資制度改革仍處于初期階段,尚存一系列有待進一步解決的問題。為不斷完善外商投資制度,本文認為,應審慎完善投資準入制度,加強負面清單的頂層設計;積極改善商事登記備案制度,降低交易費用、提高行政管理效率;繼續(xù)探索創(chuàng)新事中事后監(jiān)管制度,提高監(jiān)管的約束和激勵效應。
[Abstract]:In the reform of foreign investment system, China's free trade experimental area has established a foreign investment admission system based on pre-entry national treatment and negative list management mode. The commercial registration and filing system is characterized by the "one-stop" service of government administrative examination and approval, and the supervision system that cancels the prior examination and approval and strengthens the supervision after the event. The foreign investment system in the free trade test area is in line with the rules of international economic and trade investment, which will play a good role in demonstrating the establishment and implementation of foreign investment system in other free trade zones in China in the future. However, at present, the reform of foreign investment system is still in the initial stage, and there are still a series of problems to be solved. In order to continuously perfect the foreign investment system, this paper holds that we should prudently perfect the investment access system, strengthen the top-level design of the negative list, actively improve the commercial registration and record system, reduce transaction costs, and improve the efficiency of administration and management. Continue to explore the innovation of the ex-post regulatory system to improve regulatory constraints and incentive effects.
