【摘要】：近年來,由于進(jìn)出口貿(mào)易不斷增長,中國已超越美國成為世界最大的進(jìn)出口貿(mào)易國家,但伴隨而來的國際貿(mào)易摩擦也在不斷增加。反傾銷作為WTO框架內(nèi)合法的歧視性貿(mào)易手段,被廣大成員國用來保護本國的產(chǎn)業(yè)：美國和歐盟等發(fā)達(dá)地區(qū)多次通過反傾銷來限制中國產(chǎn)品的出口,給中國企業(yè)造成了巨大損失；這種態(tài)勢已經(jīng)逐漸蔓延到發(fā)展中國家,其中印度已經(jīng)連續(xù)多年成為對中國企業(yè)發(fā)起反傾銷調(diào)查最多的國家。為了加強中印進(jìn)出口貿(mào)易交流,減少我國企業(yè)因遭受反傾銷調(diào)查所造成的損失,深入研究印度對中國企業(yè)反傾銷調(diào)查的原因、影響及對策很有必要。本文主要著手分析印度反傾銷的法律機制和法律程序,更多揭示中國企業(yè)對印度出口時所面臨的反傾銷調(diào)查的關(guān)鍵問題。從不同方面去觀察當(dāng)前印度對中國企業(yè)發(fā)動反傾銷調(diào)查的背景和現(xiàn)狀,闡述當(dāng)前中國企業(yè)對印度出口所面臨的嚴(yán)峻形勢,并從不同的角度去分析貿(mào)易摩擦對中印雙方所造成的不良影響。造成這種局面的因素是多方面的,雙方是基于各自經(jīng)濟形勢和利益需求去考慮問題,而忽略了雙方需要更多地展開對話與合作才能實現(xiàn)矛盾的緩和、局面的雙贏。文章通過政府、行業(yè)協(xié)會和企業(yè)三個方面去尋找解決問題的對策,三方相互串聯(lián)和加強協(xié)作才能更好實現(xiàn)貿(mào)易摩擦的減少,才能推動中印貿(mào)易的可持續(xù)發(fā)展。
[Abstract]:In recent years, with the increasing of import and export trade, China has overtaken the United States to become the largest import and export country in the world, but the international trade friction is also increasing. Anti-dumping, as a legitimate and discriminatory trade means within the framework of WTO, is used by the vast number of member countries to protect their own industries: the United States and the European Union and other developed regions have repeatedly restricted the export of Chinese products through anti-dumping, which has caused huge losses to Chinese enterprises; This trend has gradually spread to developing countries, among which India has been the country that has initiated the most anti-dumping investigations against Chinese companies for many years. In order to strengthen the exchange of import and export trade between China and India, and reduce the losses caused by anti-dumping investigation, it is necessary to study the causes of India's anti-dumping investigation against Chinese enterprises. This paper mainly analyzes the legal mechanism and procedure of India's anti-dumping, and reveals the key problems of the anti-dumping investigation that Chinese enterprises face when they export to India. To observe the background and current situation of India's anti-dumping investigation against Chinese enterprises from different aspects, and to expound the grim situation that Chinese enterprises are facing in exporting to India. And from different angles to analyze the adverse impact of trade friction on China and India. There are many factors that cause this kind of situation. The two sides consider the problem based on their own economic situation and interest demand, but ignore that both sides need more dialogue and cooperation in order to realize the relaxation of the contradiction and the win-win situation. Through the government, trade associations and enterprises to find solutions to the problem, the three parties in tandem and strengthen cooperation to achieve a better reduction of trade friction, in order to promote the sustainable development of Sino-Indian trade.
