【摘要】:隨著社會(huì)發(fā)展的不斷進(jìn)步,各行各業(yè)的經(jīng)濟(jì)活動(dòng)都日趨規(guī)范化,勞資關(guān)系作為社會(huì)經(jīng)濟(jì)活動(dòng)中較為重要的社會(huì)關(guān)系之一,對(duì)社會(huì)、經(jīng)濟(jì)和諧穩(wěn)定發(fā)展起到不容小覷的作用。自改革開放以來,深圳市服務(wù)行業(yè)得到了快速發(fā)展,深圳市的服務(wù)行業(yè)已經(jīng)成為了全市經(jīng)濟(jì)的重要組成部分。隨著深圳市服務(wù)行業(yè)的不斷發(fā)展,其經(jīng)濟(jì)活動(dòng)的過程中出現(xiàn)的勞資關(guān)系問題也引起了社會(huì)各界的普遍關(guān)注,解決勞資關(guān)系問題、穩(wěn)定社會(huì)發(fā)展是當(dāng)前擺在我們面前的一項(xiàng)重要任務(wù)。本文以深圳市娛樂服務(wù)行業(yè)勞資關(guān)系為研究對(duì)象,分析勞資關(guān)系的基本概念和勞資關(guān)系治理的含義,提出了和諧勞資關(guān)系的特征和構(gòu)建和諧勞資關(guān)系的基本原則。以深圳市羅湖區(qū)娛樂服務(wù)行業(yè)的勞資關(guān)系治理為例,通過經(jīng)營主體、從業(yè)人員、勞資關(guān)系的現(xiàn)狀為出發(fā)點(diǎn),探討服務(wù)行業(yè)勞資關(guān)系存在的問題及原因,較為突出的現(xiàn)實(shí)問題為變顯性違法為隱性違法;變集中收取為逐月克扣;變單獨(dú)維權(quán)為串聯(lián)維權(quán);變勞動(dòng)關(guān)系為勞務(wù)關(guān)系,并從社會(huì)因素、企業(yè)因素、從業(yè)人員因素、政府監(jiān)管因素幾個(gè)方面分析出現(xiàn)以上問題的原因。作為治理區(qū)域勞資關(guān)系的羅湖區(qū)勞動(dòng)行政部門,通過舉辦普法培訓(xùn)、推進(jìn)簽訂集體合同、嚴(yán)格把控特殊工時(shí)審批來加強(qiáng)事前控制、規(guī)范勞動(dòng)用工管理,同時(shí)做好信訪和調(diào)解工作、引入第三方社會(huì)力量開展調(diào)解等措施強(qiáng)化信訪爭(zhēng)議調(diào)處機(jī)制,啟用電子化監(jiān)督、創(chuàng)新仲裁配套服務(wù)提高仲裁效率,嚴(yán)懲欠薪、提質(zhì)提速、規(guī)范勞動(dòng)監(jiān)察制度等手段,有效避免或減少了勞資糾紛問題的發(fā)生。由案例分析出勞資關(guān)系治理存在的問題,在遵循原則的基礎(chǔ)上,結(jié)合實(shí)際情況,提出具有實(shí)操性的合理化建議:完善系統(tǒng)性的配套政策,加大源頭控制力度、強(qiáng)化勞資糾紛預(yù)防機(jī)制,梳理勞動(dòng)信訪秩序、引導(dǎo)員工依法守序上訪,多方聯(lián)動(dòng)、加強(qiáng)勞資糾紛事中處置事后穩(wěn)控措施,明確娛樂服務(wù)行業(yè)定位優(yōu)化產(chǎn)業(yè)布局,充分發(fā)揮工會(huì)組織協(xié)調(diào)勞動(dòng)關(guān)系的積極作用,積極引導(dǎo)行業(yè)協(xié)會(huì)的成立。從事前、事中、事后的角度提出治理對(duì)策,以平衡勞資關(guān)系力量,保障勞動(dòng)者的合法利益,確保娛樂服務(wù)行業(yè)的健康穩(wěn)定和諧發(fā)展。
[Abstract]:With the continuous progress of social development, economic activities in all walks of life are becoming more and more standardized. As one of the more important social relations in social economic activities, labor relations play an important role in the harmonious and stable development of society and economy. Since the reform and opening up, the service industry in Shenzhen has developed rapidly, and the service industry has become an important part of the economy of Shenzhen. With the continuous development of the service industry in Shenzhen, the problems of labor relations in the process of its economic activities have also aroused widespread concern from all walks of life in the society. Stabilizing social development is an important task facing us at present. This paper takes the industrial relations of entertainment service industry in Shenzhen as the research object, analyzes the basic concept of the labor relations and the meaning of the management of the labor relations, puts forward the characteristics of the harmonious labor relations and the basic principles of constructing the harmonious labor relations. Taking the management of industrial relations in the entertainment service industry of Luohu District in Shenzhen as an example, this paper discusses the problems and causes of the labor relations in the service industry through the starting point of the present situation of the business subjects, employees and labor relations. The more prominent practical problems are changing overt illegal to recessive illegal; changing concentrated collection into monthly deduction; turning individual rights protection into series rights; changing labor relations into labor relations, and changing social factors, enterprise factors, and employees' factors, The reasons for the above problems are analyzed in several aspects of government supervision. As the administrative department of labor in Luohu District, which governs the regional labor relations, by organizing training in popularizing the law, promoting the signing of collective contracts, strictly controlling the examination and approval of special working hours to strengthen prior control, and standardizing the management of labor and employment, At the same time, we should do a good job in the work of petition and mediation, introduce third party social forces to carry out mediation and other measures to strengthen the mechanism of handling disputes between letters and visits, use electronic supervision, innovate the matching services for arbitration, improve the efficiency of arbitration, severely punish arrears of pay, and speed up quality and speed. Standardizing labor inspection system can effectively avoid or reduce the occurrence of labor disputes. On the basis of following the principle and combining with the actual situation, the paper analyzes the problems existing in the management of labor relations by case, and puts forward some reasonable suggestions with practical characteristics: perfecting the systematic supporting policies, increasing the control of the source, Strengthen the labor dispute prevention mechanism, comb the order of labor petition, guide the staff to follow the order of petition, cooperate with each other, strengthen the measures of stability and control in dealing with the labor dispute, clarify the position of entertainment service industry, optimize the industrial layout, Give full play to the positive role of trade union organizations in coordinating labor relations and actively guide the establishment of trade associations. In order to balance the strength of labor relations, protect the legitimate interests of laborers and ensure the healthy, stable and harmonious development of the entertainment service industry, the author puts forward some countermeasures from the perspective of the former and the latter.
