【摘要】：隨著經(jīng)濟全球化的發(fā)展,“貿(mào)易便利化”問題早已成為各國貿(mào)易發(fā)展的重要方向。尤其是在多哈回合談判通過《貿(mào)易便利化協(xié)定》之后,世界貿(mào)易組織的各成員國家更是在做出接受《貿(mào)易便利化協(xié)定》后,根據(jù)本國現(xiàn)行貿(mào)易便利化的實施狀況,進行相應(yīng)變革。論文從“貿(mào)易便利化”這一概念出發(fā),對我國已接受但還未正式生效的《貿(mào)易便利化協(xié)定》做了概述,介紹了其主要內(nèi)容。因為該協(xié)定主要內(nèi)容涉及到的是與海關(guān)有關(guān)的貿(mào)易便利化措施,因此,重點分析了該協(xié)定對我國海關(guān)制度即將產(chǎn)生的重要影響,在對比我國現(xiàn)行海關(guān)制度關(guān)于貿(mào)易便利化制度的規(guī)定,提出對我國海關(guān)貿(mào)易便利化制度的挑戰(zhàn),最后提出了關(guān)于完善我國海關(guān)貿(mào)易便利化制度的建議,以便推進我國貿(mào)易便利化制度的發(fā)展。全文共可以分為五個部分。第一部分是緒論。主要介紹了目前《貿(mào)易便利化協(xié)定》對我國海關(guān)貿(mào)易便利化制度的影響及對策研究的背景和意義,以及當(dāng)前學(xué)者對該領(lǐng)域的研究現(xiàn)狀和重要文獻,給出了本文研究的基本思路和基本內(nèi)容。第二部分是對《貿(mào)易便利化協(xié)定》所做的概述。介紹了“貿(mào)易便利化”的概念,《貿(mào)易便利化協(xié)定》的主要談判歷程,以及《貿(mào)易便利化協(xié)定》法律文本的主要內(nèi)容。對《貿(mào)易便利化協(xié)定》做了必要的介紹。第三部分主要介紹《貿(mào)易便利化協(xié)定》對我國海關(guān)貿(mào)易便利化制度的影響,通過對比我國現(xiàn)行海關(guān)貿(mào)易便利化制度和《貿(mào)易便利化協(xié)定》的規(guī)定,從透明度義務(wù)、“單一窗口”制度和海關(guān)行政裁定三個方面來分析該協(xié)定即將帶給我國海關(guān)貿(mào)易便利化制度的影響。第四部分主要介紹的是我國海關(guān)貿(mào)易便利化制度目前存在的不足,分別從海關(guān)貿(mào)易便利化制度的透明度、口岸機構(gòu)的多頭管理以及復(fù)雜的海關(guān)行政裁定制度三個方面進行了總結(jié)。第五部分是在提出我國海關(guān)貿(mào)易便利化制度不足的基礎(chǔ)上,提出在《貿(mào)易便利化協(xié)定》視野下,我國海關(guān)貿(mào)易便利化制度完善的建議。立足于《貿(mào)易便利化協(xié)定》和我國海關(guān)貿(mào)易便利化進程中涉及到的主要方面,這些建議主要包括兩個方面,即分別從海關(guān)和其相關(guān)的配套制度提出完善建議。
[Abstract]:With the development of economic globalization, the issue of "trade facilitation" has long been an important direction for the development of trade among countries, especially after the Doha Round negotiations adopted the Agreement on Trade Facilitation. After accepting the Agreement on Trade Facilitation, the member countries of the World Trade Organization have made corresponding changes according to the implementation status of their current trade facilitation. This paper starts from the concept of "trade facilitation". The Agreement on Trade Facilitation, which has been accepted by our country but has not yet entered into force, is summarized and its main content is introduced. Since the main contents of the Agreement relate to trade facilitation measures related to customs, therefore, This paper analyzes the important influence that the agreement will have on the customs system of our country, and puts forward the challenge to the customs trade facilitation system of our country by contrasting the provisions on the trade facilitation system of the current customs system of our country. Finally, the paper puts forward some suggestions on how to improve China's customs trade facilitation system. In order to promote the development of China's trade facilitation system, the full text can be divided into five parts. The first part is the introduction. It mainly introduces the impact of the Agreement on Trade Facilitation on China's customs trade facilitation system and its impact on China's customs trade facilitation system. The background and significance of strategic research, As well as the current research status and important literature in this field, The second part is an overview of the Agreement on Trade Facilitation. The concept of "Trade Facilitation" and the main negotiation process of the Agreement on Trade Facilitation are introduced. As well as the main contents of the legal text of the Agreement on Trade Facilitation. The necessary introduction is made to the Agreement on Trade Facilitation. The third part mainly introduces the impact of the Agreement on the Trade Facilitation Agreement on the customs trade facilitation system in China. By comparing the existing customs trade facilitation system with the provisions of the Agreement on Trade Facilitation, This paper analyzes the impact of the agreement on China's customs trade facilitation system from the three aspects of transparency obligations, "single window" system and customs administrative ruling. Part 4th mainly introduces China's customs trade facilitation system. The shortcomings that exist at present, It summarizes the transparency of the customs trade facilitation system, the long management of the port agencies and the complex customs administrative ruling system. Part 5th is based on the suggestion that the customs trade facilitation system of our country is inadequate. Under the vision of the Agreement on Trade Facilitation, the paper puts forward some suggestions for the perfection of the customs trade facilitation system in China. It is based on the Agreement on Trade Facilitation and the main aspects involved in the process of customs trade facilitation in China. These suggestions mainly include two aspects, that is, from the customs and its related supporting system to put forward suggestions to improve.
