【摘要】：隨著中國(guó)加入世界貿(mào)易組織，其對(duì)外貿(mào)易取得了舉世矚目的成就。對(duì)外貨物貿(mào)易總額從1978年的206.4億美元到2013年的41603.1億美元增長(zhǎng)了200多倍，一躍成為世界貨物貿(mào)易的第一大國(guó)。我國(guó)在享受著WTO倡導(dǎo)的貿(mào)易自由化帶來的便利與好處的同時(shí)，也遭受著越來越多的貿(mào)易救濟(jì)調(diào)查，在眾成員國(guó)中，美國(guó)是對(duì)華發(fā)起貿(mào)易救濟(jì)調(diào)查最多的國(guó)家。并且隨著時(shí)代的變遷，其對(duì)我國(guó)貿(mào)易救濟(jì)調(diào)查手段也隨之進(jìn)行了變化。2006年以前，我國(guó)遭遇最多的貿(mào)易救濟(jì)調(diào)查是其對(duì)我國(guó)出口產(chǎn)品進(jìn)行的反傾銷調(diào)查。2006年隨著美國(guó)打破對(duì)非市場(chǎng)經(jīng)濟(jì)國(guó)家不適用反補(bǔ)貼法的政策，首次對(duì)我國(guó)的銅版紙進(jìn)行了反補(bǔ)貼調(diào)查，開創(chuàng)了對(duì)我國(guó)出口產(chǎn)品進(jìn)行反補(bǔ)貼與反傾銷合并調(diào)查的先例后。“雙反”調(diào)查成為美國(guó)對(duì)我國(guó)進(jìn)行貿(mào)易救濟(jì)調(diào)查的新手段，此后美國(guó)頻繁的對(duì)中國(guó)的出口產(chǎn)品進(jìn)行“雙反”調(diào)查，特別是2008年國(guó)際金融危機(jī)的爆發(fā)，更是加大了美國(guó)對(duì)華“雙反”調(diào)查的力度，截止到2014年7月，美國(guó)已對(duì)華進(jìn)行了44起“雙反”調(diào)查。 美國(guó)對(duì)華進(jìn)行“雙反”調(diào)查并且征收高額的“雙反”稅率，限制了我國(guó)對(duì)美國(guó)相關(guān)產(chǎn)品的出口，，影響了我國(guó)對(duì)外經(jīng)濟(jì)的發(fā)展，對(duì)我國(guó)國(guó)內(nèi)相關(guān)政策的制定與實(shí)施產(chǎn)生了影響，同時(shí)還影響了中美兩國(guó)經(jīng)貿(mào)關(guān)系的健康發(fā)展，因此研究美國(guó)對(duì)華頻繁進(jìn)行“雙反”調(diào)查的原因，“雙反”調(diào)查對(duì)我國(guó)的影響以及我國(guó)應(yīng)如何應(yīng)對(duì)“雙反”調(diào)查等問題并找到答案就顯得及其重要。并且可以為我國(guó)經(jīng)濟(jì)和對(duì)外貿(mào)易的健康發(fā)展提供理論依據(jù)和政策參考，因此本文也有著非常重要的現(xiàn)實(shí)意義。 本文首先對(duì)目前國(guó)內(nèi)外學(xué)者對(duì)“雙反”的研究進(jìn)行了簡(jiǎn)單的綜述，然后從理論上分析了“雙反”調(diào)查產(chǎn)生的四類貿(mào)易效應(yīng)并且建立一個(gè)動(dòng)態(tài)博弈模型，著重分析了貿(mào)易限制效應(yīng)。第三部分首先對(duì)美國(guó)對(duì)華發(fā)起“雙反”調(diào)查的發(fā)展歷程并對(duì)截止2014年7月美國(guó)對(duì)華以及對(duì)外所有“雙反”案件進(jìn)行了統(tǒng)計(jì)，闡述了美國(guó)對(duì)華“雙反”調(diào)查的現(xiàn)狀并通過對(duì)比得出美國(guó)對(duì)華“雙反”調(diào)查特點(diǎn)最后對(duì)美國(guó)對(duì)華頻繁進(jìn)行“雙反”調(diào)查的原因進(jìn)行了分析。接下來的部分為論文的重點(diǎn)部分，第四部分對(duì)美國(guó)對(duì)華從2006年至2013年進(jìn)行“雙反”調(diào)查的產(chǎn)品的出口額進(jìn)行了描述性統(tǒng)計(jì)分析，可以看出遭受“雙反”調(diào)查的產(chǎn)品大部分都產(chǎn)生了貿(mào)易限制效應(yīng)，但是貿(mào)易限制效果的持續(xù)性卻不同。第五部分選取截止2011年美國(guó)對(duì)華進(jìn)行的30起“雙反”調(diào)查的涉案產(chǎn)品的面板數(shù)據(jù)對(duì)美國(guó)對(duì)華“雙反”調(diào)查的限制效應(yīng)進(jìn)行了實(shí)證分析，結(jié)果表明“雙反”調(diào)查不管結(jié)果如何都有一個(gè)貿(mào)易調(diào)查效應(yīng)，減少中國(guó)產(chǎn)品的出口，“雙反”征收的稅率越多，貿(mào)易限制效應(yīng)越大。最后論文根據(jù)前面的分析分別從企業(yè)和政府兩方面提出了應(yīng)對(duì)雙反調(diào)查的措施。
[Abstract]:With China's accession to the World Trade Organization. Its foreign trade has made remarkable achievements. The total volume of foreign trade in goods increased by more than 200 times from US $20.64 billion in 1978 to US $four tillion one hundred and sixty billion three hundred and ten million in 2013. China is enjoying the convenience and benefit of the trade liberalization advocated by WTO, but also suffers more and more trade relief investigations, among the member countries. The United States is the country that initiated the most trade relief survey to China. And with the change of the times, the means of trade relief investigation on our country have also changed. Before 2006. In 2006, the United States broke the policy of not applying countervailing law to non-market economy countries. The countervailing investigation of coated paper in China was carried out for the first time. After creating a precedent of combining countervailing and antidumping investigations into our export products, the "double countervailing" investigation has become a new means for the United States to carry out trade relief investigations against China. Since then, the United States has frequently carried out "double opposition" investigations on China's exports, especially the outbreak of the international financial crisis in 2008, which has increased the strength of the "double opposition" investigation into China by the United States. By July 2014, the United States had conducted 44 double-counter investigations into China. The United States has carried out "double counter" investigation on China and levied a high "double counter" tax rate, which has restricted China's exports of related products to the United States and affected the development of China's foreign economy. At the same time, it also affects the healthy development of Sino-US economic and trade relations. Therefore, it studies the reasons why the United States frequently carries out "double negative" investigation on China. The influence of "double reaction" investigation on our country and how to deal with it. It is very important to investigate and find out the questions, and it can provide the theoretical basis and policy reference for the healthy development of our economy and foreign trade. Therefore, this paper also has very important practical significance. In this paper, the current domestic and foreign scholars' research on "double reaction" is briefly reviewed, and then the four kinds of trade effects caused by "double reaction" investigation are theoretically analyzed and a dynamic game model is established. In the third part, the author analyzes the development course of the "double reaction" investigation initiated by the United States against China and makes statistics on all the "double reaction" cases of the United States against China and foreign countries as of July 2014. This paper expounds the present situation of American "double opposition" investigation into China, and draws the conclusion that the characteristics of American "double opposition" investigation into China are frequently carried out by the United States in the end, "double opposition" to China is frequently carried out by the United States. The reasons for the investigation are analyzed. The next part is the key part of the paper. In the 4th part, the author makes a descriptive statistical analysis of the export value of the products from 2006 to 2013 of the "double counter" survey conducted by the United States of America to China. It can be seen that most of the products subject to the "double reaction" survey have had a trade restriction effect. However, the persistence of trade restrictions is different. 5th selected panel data of 30 cases of "double counter" surveys conducted by the United States against China as of 2011. The limited effect of the investigation is empirically analyzed. The results show that no matter what the results of the "double reaction" survey has a trade survey effect, reduce the export of Chinese products, "double reaction" tax rate is more. Finally, according to the previous analysis, the paper puts forward the measures to deal with the double reverse investigation from the two aspects of enterprises and government respectively.
